𝐒𝐮𝐩𝐫𝐞𝐦𝐞 𝐂𝐨𝐮𝐫𝐭 𝐔𝐩𝐡𝐨𝐥𝐝𝐬 𝐂𝐨𝐧𝐯𝐢𝐜𝐭𝐢𝐨𝐧 𝐟𝐨𝐫 𝐏𝐬𝐲𝐜𝐡𝐨𝐥𝐨𝐠𝐢𝐜𝐚𝐥 𝐕𝐢𝐨𝐥𝐞𝐧𝐜𝐞 𝐔𝐧𝐝𝐞𝐫 𝐑𝐀 𝟗𝟐𝟔𝟐

In the landmark decision 𝐆.𝐑. 𝐍𝐨. 𝟐𝟕𝟎𝟐𝟓𝟕, the Supreme Court affirmed the conviction of a husband found guilty of psychological violence under Section 5(i) of Republic Act No. 9262, also known as the 𝐀𝐧𝐭𝐢-𝐕𝐢𝐨𝐥𝐞𝐧𝐜𝐞 𝐀𝐠𝐚𝐢𝐧𝐬𝐭 𝐖𝐨𝐦𝐞𝐧 𝐚𝐧𝐝 𝐓𝐡𝐞𝐢𝐫 𝐂𝐡𝐢𝐥𝐝𝐫𝐞𝐧 𝐀𝐜𝐭.

The Court ruled that engaging in an extramarital relationship, abandoning the wife and children, and failing to provide financial support caused the victim mental and emotional anguish, satisfying the elements of the offense.

𝐊𝐞𝐲 𝐓𝐚𝐤𝐞𝐚𝐰𝐚𝐲𝐬 𝐟𝐫𝐨𝐦 𝐭𝐡𝐞 𝐃𝐞𝐜𝐢𝐬𝐢𝐨𝐧:

1️⃣ 𝐏𝐬𝐲𝐜𝐡𝐨𝐥𝐨𝐠𝐢𝐜𝐚𝐥 𝐕𝐢𝐨𝐥𝐞𝐧𝐜𝐞 𝐃𝐞𝐟𝐢𝐧𝐞𝐝:
Acts of inflicting emotional and mental suffering, such as abandonment, public ridicule, and denial of financial support, constitute psychological violence under RA 9262.

2️⃣ 𝐍𝐨 𝐍𝐞𝐞𝐝 𝐟𝐨𝐫 𝐏𝐬𝐲𝐜𝐡𝐨𝐥𝐨𝐠𝐢𝐜𝐚𝐥 𝐄𝐯𝐚𝐥𝐮𝐚𝐭𝐢𝐨𝐧:
The Supreme Court reiterated that a psychological evaluation is not indispensable in proving psychological violence. The victim's testimony alone, if credible and consistent, is sufficient to establish mental and emotional suffering.

3️⃣ 𝐋𝐞𝐠𝐚𝐥 𝐂𝐨𝐧𝐬𝐞𝐪𝐮𝐞𝐧𝐜𝐞𝐬:
The accused was sentenced to an indeterminate penalty of prison correctional to prison mayor, fined PHP 200,000, and ordered to undergo mandatory psychological counseling or psychiatric treatment.

4️⃣ 𝐃𝐞𝐧𝐢𝐚𝐥 𝐚𝐬 𝐚 𝐃𝐞𝐟𝐞𝐧𝐬𝐞 𝐢𝐬 𝐈𝐧𝐬𝐮𝐟𝐟𝐢𝐜𝐢𝐞𝐧𝐭:
The Court emphasized that mere denial of wrongdoing is not enough to overcome the victim’s positive and categorical testimony.

𝐖𝐡𝐚𝐭 𝐓𝐡𝐢𝐬 𝐌𝐞𝐚𝐧𝐬 𝐟𝐨𝐫 𝐖𝐨𝐦𝐞𝐧 𝐚𝐧𝐝 𝐅𝐚𝐦𝐢𝐥𝐢𝐞𝐬:
This decision reinforces the protection offered under RA 9262 and highlights the seriousness of psychological abuse within relationships. Women and their children are encouraged to seek legal remedies if they experience emotional or financial abuse in their domestic life.

𝐒𝐮𝐩𝐫𝐞𝐦𝐞 𝐂𝐨𝐮𝐫𝐭 𝐀𝐬𝐬𝐨𝐜𝐢𝐚𝐭𝐞 𝐉𝐮𝐬𝐭𝐢𝐜𝐞 𝐀𝐦𝐲 𝐋𝐚𝐳𝐚𝐫𝐨-𝐉𝐚𝐯𝐢𝐞𝐫, in her powerful speech to the new lawyers of 2025, reminded them that being a lawyer is not just about carrying the title “𝐀𝐭𝐭𝐲.” but about embodying humility, integrity, and humanity.

Her key lessons for every lawyer:

1️⃣ 𝐁𝐞 𝐇𝐮𝐦𝐛𝐥𝐞 – Respect is earned through humility, not through flaunting titles.
2️⃣ 𝐊𝐞𝐞𝐩 𝐘𝐨𝐮𝐫 𝐖𝐨𝐫𝐝 – Your integrity is your most valuable asset.
3️⃣ Excellence or Nothing – Strive for the best in everything, no matter how small.
4️⃣ 𝐍𝐞𝐯𝐞𝐫 𝐆𝐢𝐯𝐞 𝐔𝐩 – Resilience is key in the legal profession.
5️⃣ 𝐁𝐞 𝐋𝐢𝐠𝐡𝐭-𝐇𝐞𝐚𝐫𝐭𝐞𝐝 – Bring joy into the workplace and to those around you.
6️⃣ 𝐋𝐨𝐨𝐤 𝐆𝐨𝐨𝐝 𝐭𝐨 𝐅𝐞𝐞𝐥 𝐆𝐨𝐨𝐝 – Your presence reflects your respect for the profession.
7️⃣ 𝐁𝐞 𝐊𝐢𝐧𝐝 – Small acts of kindness leave lasting impressions.
