Yesterday, on 29 April 2026, Louis Liaw Chambers conducted our monthly complimentary webinar titled “Fixed-Term Contracts: Legality and Risk of Permanence.”

The session focused on a topic often misunderstood or overlooked by employers — the legal boundaries between fixed-term and permanent employment contracts, and how a fixed-term contract may, in practice, operate as a permanent one, exposing organisations to significant risk under Malaysian employment law.

During the discussion, we explored matters including:

* The legal distinction between a genuine fixed-term contract and a permanent contract in Malaysia
* The risks of successive or “rolling” renewals that can result in an employee being deemed a permanent staff member
* The key considerations (intention, conduct, and nature of work) used by the Industrial Court to determine the true status of employment
* Practical best practices for the drafting and lawful non-renewal of fixed-term contracts to mitigate unfair dismissal claims

The session was highly interactive, with participants sharing practical workplace scenarios and raising thoughtful questions on how these different contracts can be used in real organisational settings.

Around 60 participants from various industries including employers, business owners and HR professionals joined the session.
