Under the civil law, defamation includes any false statement which tends to damage a person's reputation and good name in the public perception. Anyone seeking to initiate a defamation suit must prove that i) the allegation made refers to him, ii) has been published to a third party and iii) has a tendency to publicly disrepute him.

Be careful in making false statement, either verbally or in writing, because any form of allegation that can be proven, is actionable!

Dalam undang-undang sivil, fitnah merangkumi sebarang tohmahan palsu yang mampu menjatuhkan reputasi dan nama baik seseorang di pandangan awam. Pihak yang ingin memulakan saman fitnah perlu membuktikan bahawa i) tohmahan yang dibuat merujuk kepadanya, ii) telah disiarkan kepada pihak ketiga dan iii) mempunyai kecenderungan untuk menjatuhkan reputasinya pada persepsi khalayak ramai.

Kisah benar sebagai pengajaran. Rumah kondo dibeli 20 tahun yang lalu. Disebabkan tuntutan kerja, pembeli terlepas pandang menguruskan pindah milik dari Pemaju ke atas namanya sendiri. Sekarang hendak jual dah ada potential buyer, masalah timbul bila geran hilang dan tidak diketahui. Dalam keadaan begini, kebiasaannya potential buyer akan tarik diri.

Semak geran asal anda terutamanya jika anda pemilik hartanah strata @ kediaman jenis bertingkat.

Q: Once you have gotten the keys to your strata property, does it mean the property is yours?
A: It is not as easy as that because in Malaysia, we follow the Australian’s Torrens system which means registration of your name on title vests title or interest over the property except otherwise statutorily provided. So, when the strata title is yet to be issues, your property could be sitting on an unsubdivided property registered in the name of the proprietor or developer.

The situation where the strata title is not registered in the name of the purchaser has been determined by the Federal Court, being the highest tier of courts in Malaysia in the 2016 case of Tan Ong Ban v Teoh Kim Heng [2016] 2 MLJ 23.

The Federal Court decided that:-
1) The purchaser who had paid the purchase price in full, was the beneficial owner of the property and enjoyed a right in rem over the property.
2) The purchaser who had not paid the full purchase price of the property, was at best clothes with a right in personam as against the respondent upon the ex*****on of SPA and payment made.

In Tan Ong Ban case, the 1st Purchaser entered into agreement with the Developer to buy an apartment unit in Bandar Jelutong, Penang. 1st Purchaser paid a deposit of RM5,250 and the remaining payments were scheduled accordingly. The developer then sold the same apartment to the 2nd Purchaser who paid the purchase price in full. The Federal Court decided in favour of the 2nd Purchaser in that he became a beneficial owner once he paid the purchase price in full. As for the 1st Purchaser, he only had the right to sue the Developer under the SPA and claim for the monies paid. However, the Federal Court noted, “Unfortunately, the appellant (the 1st Purchaser) was left without remedy as JAS had been wound up”. Twas was the sad case of the 1st Purchaser.

Siti wants to sell her condominium. She has a ready cash buyer for the condo. However, she could not proceed with the sale because she does not have a strata title and the Developer cannot be contacted.

What is strata title?
Strata title (geran strata) is an ownership document for subdivided properties such as high-rise buildings, town houses, flats, apartments, condominiums, and commercial buildings.

By not knowing your rights as a strata property owner, it can translate to 1001 problems in the future. There are other instances where the Developer is wound up before the issuance of strata title. In worst case scenario, there are owners who had resorted to legal action against liquidator who had conducted verification exercise to ascertain ownership and obtained a vesting order to vest the properties in the liquidator and thereafter sold the properties to 3rd party purchaser. The owners end up losing their properties and still having to serve the mortgage.

We have come across one too many cases where property owners are only concerned of the whereabouts of strata titles when they face problems in selling the properties to interested buyers. If you own a stratified property, it is time for you to take precaution. This week, we will be sharing about the importance of strata title.
