2025年12月5日，于峇株巴辖地庭（Batu Pahat Sessions Court），本事务所的陈松元律师所负责之案件迎来裁决。被告于2023年被指在2022年招募一名未成年少女前往老挝及缅甸从事工作，意图将其剥削为强迫劳工，因而面对《反贩卖人口和反贩运移民法令》（ATIPSOM）第14条之控状。案件进入审讯阶段后，控方在长达两年的审理过程中共传召八名证人，以期在表面证据阶段确立被告为招募及剥削受害者之人。

今日，法庭在详阅控辩双方所提交的书面陈词，并听取双方的口头陈述后，法官宣布休庭一小时进行审慎的内部审议。其后，法庭裁定控方未能在表面证据阶段确立其案件。由于控方所呈证据不足以支撑控状，被告获判无罪释放（discharged and acquitted）。

本事务所谨向当事人所给予的信任致以诚挚谢意，同时亦感谢团队成员及学徒在审讯与准备陈词期间所作出的努力与协助。此次判决成果，有赖于全体团队专业的付出与坚持。

On 5 December 2025, at the Batu Pahat Sessions Court, the case handled by our firm’s lawyer, Mr. Tan, reached its conclusion. The accused had been charged in 2023 under Section 14 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act (ATIPSOM) for allegedly recruiting an underage girl in 2022 to work in Laos and Myanmar with the intention of exploiting her as forced labour. During the two-year trial, the prosecution called a total of eight witnesses in an attempt to establish a prima facie case that the accused was the individual responsible for recruiting and exploiting the victim.

Today, after reading the written submissions filed by both the prosecution and the defence, and upon hearing the oral submissions from both parties, the presiding judge adjourned the matter for one hour to deliberate. Thereafter, the Court ruled that the prosecution had failed to establish its case at the prima facie stage. As the evidence presented was insufficient to support the charge, the accused was discharged and acquitted.

We extend our sincere appreciation to our client for the trust placed in us. We also thank our team members and pupils for their dedicated assistance throughout the trial and during the preparation of the submissions. This positive outcome is the result of the team’s collective professionalism and commitment.

We are delighted to welcome Ms. Soh Zhi Yin and Ms. Tan Fong Ling who have recently joined Messrs. Song Yan & Tang (Batu Pahat) as our pupil-in-chambers.

Zhi Yin graduated with an LLB from Aberystwyth University and went on to complete the Bar Course at Northumbria University. She was called to the Bar of England and Wales by the Honourable Society of the Middle Temple in November 2024. She is truly honoured to embark on her chambering journey with the firm. While her passion lies in litigation, she is equally eager to explore different areas of practice during her pupillage in order to build a strong and versatile legal foundation. She looks forward to sharpening her skills and contributing meaningfully to the firm’s work, while learning alongside the team. Beyond her legal aspirations, she believes in approaching every challenge with dedication and an open mind, and is excited to grow both professionally and personally during this journey.

Fong Ling graduated with a Bachelor of Laws (Hons) from Universiti Sultan Zainal Abidin (UniSZA). She recently completed her 4-year law degree and is now beginning her 9-month pupillage with our firm. During her studies, she served as a committee member of the UniSZA Moot Club, where she gained valuable experience through mooting competitions. She looks forward to gaining hands-on experience, developing her legal skills, and growing in the profession.

We are excited to have both Zhi Yin and Fong Ling on board, and we believe that during their 9 months pupillage with our firm, they will gain meaningful experience, continue to learn and grow, and gradually unlock their potential in their legal careers.
