COURT FINDS DRIVER NOT RESPONSIBLE FOR CHILD ROAD ACCIDENT

A court has dismissed a personal injury claim involving a 5-year-old child who suffered serious injuries after being struck by a pickup truck near a school.

The judge found the driver was travelling at approximately 20 mph and that the child unexpectedly emerged from behind a parked vehicle, meaning the accident could not have been avoided.

While describing the incident as tragic, the Court confirmed there were no warning signs requiring the driver to slow further.

The judgement also highlights situations where drivers should exercise extra caution around children near roads.

DRIVER FOUND NOT LIABLE IN CHILD PEDESTRIAN ACCIDENT CASE

The Court in Atkinson v Kennedy found that an LGV driver was not responsible for a collision involving a 7-year-old pedestrian.

Although the driver had been travelling above the speed limit before reaching the junction, the Court held that the child’s sudden movement into the road made the accident unavoidable.

The case demonstrates that:

There is no automatic presumption of liability against drivers.
Every road traffic accident case depends on its specific facts.
The Court will consider whether the collision could realistically have been avoided.

GADSBY v HAYES (2024)
A recent case highlights an important point in road traffic accident claims involving children.

A 12-year-old girl was seriously injured while crossing at a toucan crossing. However, the court found the driver was not at fault, accepting that she was driving below the speed limit and had a green light.

This case shows that even in serious incidents involving young pedestrians, liability is not always clear-cut.

Data from the government’s Compensation Recovery Unit (CRU) revealed that only 63,833 road traffic claims were registered with the CRU in the fourth quarter of 2025. This is down 24 per cent on the year before.

Since starting his traineeship, Reuben Jarvis became so much more aware of the dangers on the road. He signed up to the IAM RoadSmart Advanced Driver course with the Borders Group of Advanced Motorists (BGAM) as he wanted to ensure that he was driving in the safest possible manner for other road users. 🚗

We now have 10 members of staff with Advanced Driving qualifications. Five are Advanced Riders too! 🏍️🚗

RTA Law LLP is delighted to announce the promotion of James Stevenson to the position of Solicitor.

James undertook his traineeship with the firm and has recently qualified as a solicitor. He brings over seven years’ experience working in personal injury, having previously worked as a paralegal for both the pursuer and defender firms.

James holds a CBT motorcycle licence and is an Advanced Driver (F1RST) with IAM RoadSmart.
