🚩 Take that seriously.

If the Service Police want to speak to you about an allegation, what you say at the beginning of an investigation can become extremely important later.

You don’t have to be under arrest for legal advice to matter.

Before giving your account, understand:

⚖️ What you’re suspected of
📋 What has been disclosed
🎥 What evidence may exist
🗣️ How you should approach an interview under caution

Don’t make decisions about an interview because you’ve been told it’s “nothing to worry about”.

Get advice early.

“Just say no comment.”

It’s advice you hear all the time — but it isn’t always good advice.

A no-comment interview can absolutely be the right strategy in some cases. But in others, failing to mention something you later rely on at court can potentially harm your defence.

That’s why police interview advice should never be one-size-fits-all.

Before advising a client, a defence solicitor will consider the disclosure, the evidence, the allegation and what account — if any — should be put forward.

Sometimes that means answering questions.
Sometimes it means a prepared statement.
Sometimes it means no comment.

⚖️ “No comment” is a right. Knowing when to use it is the strategy.

And remember: independent legal advice at the police station is FREE.

🚗 Police stop a car with four people inside…

They search it.

They find drugs under one of the seats.

Nobody admits they belong to them.

So… who gets arrested? 👀

The driver?
The person sitting closest to the drugs?
Everyone in the car?

The answer isn’t always as straightforward as you might think.

Being in the same car as drugs does not automatically prove they belong to you. Police will look at the whole picture — where the drugs were found, what each person says, phone evidence, cash, forensic evidence and any other circumstances surrounding the stop.

And remember: arrest and conviction are two very different things.

If you’re arrested or asked to attend a voluntary interview, get legal advice before answering questions.

Police station legal advice is FREE, regardless of your income.

🚨 “It’s voluntary, so I can just leave… right?”

Yes — if you attend a police interview voluntarily, you are not under arrest and you are free to leave.

BUT 👇

If you leave before the interview is completed, the police may then consider whether your arrest has become necessary to allow a prompt and effective investigation.

That doesn’t mean arrest is automatic.

Police must still satisfy the legal test for arrest under s.24 PACE and be able to justify why arrest is necessary.

⚖️ Voluntary interview does not mean informal interview.

And remember — legal advice at the police station is FREE, whether you are arrested or attending voluntarily so why not use it!

🚨 “We just want you to come in for a quick chat…”

Except it might not be just a chat.

If the police invite you to attend a voluntary interview under caution, what you say can be used as evidence — and the fact you haven’t been arrested doesn’t make the situation any less serious.

One of the biggest mistakes I see is people thinking:

“I haven’t done anything wrong, so I don’t need a solicitor.”

Having a solicitor does not make you look guilty.

It means you understand what you’re being questioned about, receive legal advice before the interview and have someone there protecting your interests throughout.

And remember — legal advice at the police station is FREE, regardless of your income.

So if the police ever call and say they “just want a quick chat”…
