£75,000 secured for the family of a client following a delayed diagnosis of lung cancer.

When our client attended A&E with chest pain, a chest X-ray was reported as normal and there was thought to be no serious underlying condition.

It was only months later, after ongoing symptoms led to further investigations, that stage 4 lung cancer was diagnosed.

Independent medical experts concluded that, had the cancer been identified during the original hospital attendance, it would have been diagnosed at stage 2 rather than stage 4. Earlier treatment could have prolonged our client's life by around 22 months.

Sadly, our client passed away 14 months after diagnosis.

Jade Spenceley, medical negligence solicitor, secured a £75,000 settlement for the family. Reflecting on the outcome, she said that while no amount of compensation can replace the valuable time lost with loved ones, she hoped the settlement would provide recognition of the impact the delay had.

£30,000 secured following a delayed diagnosis of testicular torsion.

Our client attended hospital with symptoms of testicular torsion. However, an incorrect diagnosis and delays in treatment meant the condition was not identified in time. By the time the correct diagnosis was made, surgery was required, resulting in the loss of a testicle.

The consequences went beyond the physical injury, affecting our client's wellbeing and raising concerns about his fertility. Fortunately, further investigations later confirmed that he remained fertile.

Commenting on the case, Roisin Hulme, Associate Solicitor in our medical negligence team, said:

"The negligent care led to a significant and life-changing injury. The suspected diagnosis of testicular torsion ought to have been carefully considered by the treating urologist, particularly given the reported history and our client's age. I am pleased to have secured a settlement for our client which will allow him to move forward with his life."
