Inheritance tax allowances may be frozen until 2031, but property prices aren’t. As the value of your home and wider estate grows, more of your wealth could potentially fall outside your tax free allowances and become subject to inheritance tax.

Understanding your potential liability now can make a big difference when it comes to planning ahead.

Comment CLARITY to get a complimentary inheritance tax calculation and a breakdown of what your estate planning could look like.

There’s a simple gifting allowance that can help reduce the value of your estate for inheritance tax purposes.

Each tax year, you can give away up to £3,000 using your annual exemption, with no seven-year rule applying to that exempt amount. For couples, each person has their own individual allowance. There are also separate exemptions for certain smaller gifts, including gifts of up to £250 per person in qualifying circumstances.

Many people think the best estate planning strategy is simple: just give everything to the kids.

But what happens if they later go through a divorce, bankruptcy, or face creditor claims?

In this video, I explain why protecting your family’s wealth is about more than just avoiding inheritance tax, and why the right structure can make all the difference.

Gifting from surplus income can be a powerful way to pass money on while you’re still alive. If your regular income comfortably covers your normal standard of living, the genuine surplus may be gifted away and potentially fall immediately outside your estate for inheritance tax purposes.

Unlike many other gifts, there’s no seven year waiting period and there’s no fixed upper limit. The key is being able to show the gifts came from surplus income, formed part of a regular pattern and didn’t affect your usual standard of living.

Most people plan for what happens after they pass. Almost nobody plans for what happens if they lose capacity while they’re still here.

Without a Lasting Power of Attorney, your family can’t access your bank accounts, make decisions about your care, or manage your affairs, even if they desperately need to. They’d have to apply to court instead. It’s costly, slow, and avoidable.

There are two types of LPA: one covering your Property and Financial Affairs, one covering your Health and Welfare. Both can only be set up while you still have mental capacity.

Most people assume their pension follows their Will.
It doesn’t. If you’re divorced, separated, remarried, or have had children since setting up your pension, there’s a chance your nomination form is out of date.

That means when you pass away, your pension could end up going to someone you never intended.

The scary part? Most people don’t realise this until it’s too late.

Changing how a jointly owned property is legally held could make a major difference to what happens to your share after you die. The video explains the difference between owning as joint tenants and tenants in common, where each person instead owns a defined share of the property.

It also explains how combining tenants in common ownership with the right will and trust structure can be used as part of estate planning, with the aim of protecting and preserving a share of the property for future beneficiaries. The exact outcome depends on individual circumstances, so professional legal and estate planning advice is important.

40,000 homes are sold every year in the UK to pay for care. Most of them didn’t have to be.

The reason? Most couples own their home as joint tenants, meaning when one partner passes, the survivor owns it 100%. The care system can then assess the whole property.

Switching to tenants in common and directing your 50% into a trust at the point you pass means only half the home can ever be touched. The survivor keeps full control, they just don’t own your half. And what isn’t owned can’t be taken.

Most people think estate planning starts and ends with writing a will, but that’s only half of the picture. A complete estate plan has two separate parts: death planning, which covers your will, trusts and lasting powers of attorney, and lifetime planning, which focuses on protecting your wealth while you’re still here.

Lifetime planning is where inheritance tax planning really happens. Things like gifting assets, using gift trusts, planning for business succession and structuring your wealth can all play a role in reducing future tax liabilities. Having a will is essential, but it won’t reduce inheritance tax on its own.

If you have a pet, it’s worth considering what would happen to them if you passed away. A pet clause can be included in your will to set out who you want your animals to go to, helping make sure there is a plan in place for their future care.

Pets can be an important part of the family, but their future is something that can easily be overlooked when making a will. Putting your wishes in writing can provide clarity over who should take responsibility for them and give you peace of mind that they’ll be taken care of.
