We’re pleased to recognize Lisa Newby for a significant result following a two-day chambers hearing in Victoria.

Lisa successfully defended a highly complex and technical application seeking to set aside and review a Parenting Coordinator’s determination concerning the choice of school for a child, as well as to terminate the Parenting Coordinator’s appointment.

The Court dismissed the application in its entirety, upholding the Parenting Coordinator’s determination, which was favourable to our client. The Parenting Coordinator therefore continues in their role.

The decision is also significant for the Parenting Coordinator Roster, as the proceeding involved important issues concerning the interpretation and application of its standard agreement.

Congratulations to Lisa on an excellent result and on her thoughtful, thorough, and effective advocacy for our client.

Were you fired? You may be owed fortunes in severance ⬇️

A dismissal for "just cause" or getting fired without being paid anything can feel final. In many cases, it is not. You may have been wrongfully dismissed as employers seldom have the right to just fire people.

In the most recent and groundbreaking case of Silva v. Royal Bank of Canada, 2026 ONSC 3841, one of Canada's largest banks dismissed a high-performing financial planner alleging she engaged in conduct that was so unacceptable they had to let her go and give her nothing.

The court found the dismissal was not justified, held that it was wrongful, and awarded her more than $2.6 million in damages.

Just cause or firing without pay has the highest bar in employment law. The burden is on the employer to prove it. Even so, some employers assert it in circumstances that fall well short of the legal standard.

What often matters just as much as the reason for the firing is how it was handled, whether the investigation was fair, how you were treated on the way out, and what your employer reports about you afterward. In this case, a regulatory notice stating she was dismissed for cause followed her to every prospective employer and effectively ended her career in the industry.

If you have been dismissed for cause, do not assume the label is correct. Understand your position, and your entitlements, before agreeing to anything.

We’re thrilled to celebrate a recent victory by Cathleen McClughan, and to welcome her as the newest senior lawyer at YLaw.

In J.D. v. A.S., 2026 BCSC 1520, Cathleen represented a father who had been separated from his young daughter for more than a year, despite an existing parenting order.

The Supreme Court of British Columbia found that there was no justification for withholding the child, ordered the existing parenting order enforced, and put a clear reunification plan in place for father and daughter.

It’s a meaningful result for our client and an important step toward rebuilding their relationship.

Cathleen brings more than 30 years of legal experience to YLaw, with 26 years focused on family law and civil litigation. She has appeared at every level of court and has acted as counsel in leading family law cases involving parenting, relocation, and appeals.

After four incredible years at YLaw, we're saying goodbye to one of our own as she heads off to law school.

Mahsa joined us as YLaw's very first intern and helped lay the foundation for what has since become a thriving internship program.
