In our latest blog, Articling Student (Intern) Tawfiq Kuttab unpacks a recent Ontario Superior Court decision where a builder’s attempt to tack on nearly $60,000 in unsupported charges right before closing backfired; yet neither party left unscathed.

Pre-construction deals often include clauses allowing builders to pass through certain costs at closing. But as the Court's decision in Taheripouresfahani v. Dormer Bond, 2025 ONSC 5833 makes clear, authorizing a category of charge is not the same as authorizing any amount. This article explains how unsupported closing adjustments can amount to an anticipatory breach of contract, why buyers still need to meet their own obligations even when they're in the right, and what both sides should take away from this case.

In our latest blog, Articling Student (Intern) Max Sun discusses the judgment recently obtained by Walker Law in Bank of China v Shah, in which the court found there was no genuine issue requiring a full trial.

The article explains when a summary judgment is appropriate, such as when the respondent has provided no evidence or issue that cannot be resolved on a motion, or where factors like the parties’ level of expertise leave little to no room for ambiguity. The decision is also contrasted with situations where summary judgment can be denied, like when key evidence has been hidden by wrongful conduct or there is an active cross-claim that requires a trial to resolve.
