Insurance Industry Day at the Dome.

Recently, members of HMC Lawyers had the opportunity to spend an afternoon at the Rogers Centre alongside clients, colleagues, and friends from the insurance industry.

Can you appeal an arbitration award? Only if your arbitration agreement says you can.

A recent Alberta Court of King's Bench decision is a timely reminder that the fine print matters. A right to appeal on questions of "law or fact" does not automatically include questions of mixed fact and law.

The Court also reinforced that:

▪️Exclusion of crucial evidence can be procedurally fair;

▪️Arbitrators have broad discretion in managing evidence; and

▪️Strategic choices made during the arbitration can have lasting consequences on appeal.

The takeaway? Careful drafting at the outset and disciplined decision-making during the hearing can make all the difference.

As Stampede comes to a close, we are reflecting on a number of meaningful opportunities to connect with clients and industry partners. Among them was the Calgary Construction Association's Stampede BBQ, which HMC Lawyers LLP was proud to sponsor.

HMC Lawyers LLP had an incredible time at motionball for Special Olympics, an annual fundraiser supporting the Special Olympics. The day was filled with great energy and community spirit, made even more special by spending time with the inspiring athletes.

We always value the opportunity to support such an important cause and are proud to be part of an event that celebrates inclusion, teamwork, and perseverance. Already looking forward to being back next year.
