I taught marketing, advertising, and sales at Georgian College, Canadore College and Northern College, but when I became a lawyer I ran into a legal culture that totally ignored the marketing principle: "Every decision of the firm should be made in light of the customer's wants and needs". That's not how a self-governing profession operates. Colleagues actually teased me about not charging enough.

I do not charge for Will updates. Just updated Wills for a couple and they are bringing us their house sale and are referring their son to us for family issues. Foregoing a charge for a few minutes work pays dividends.

I only charge $500 to draft separation agreements, but out of every such file, someone is getting the house, buying a house or selling the house and then they need Wills. By not running the clock I have gained clients and lots of work for the future.

At a Law Society lecture, a senior family law lawyer explained it to us : "Might as well charge your client as much as you can the first time you see them as you probably won't see them again." If you read lawyer reviews on Google or LawyerRatingz.com you will soon see the problem. Most reviews are flamingly negative except the ones that the lawyer solicits themselves. "So professional, took the time to understand my needs". Real clients don't talk like that. Glad I didn't follow the profession's advice. Once a hippy, always a hippy :)

Still cleaning up after other lawyers. My last two appointments of today were both people who have been through family court with lawyers, paid huge amounts ($40,000 and $90,000 respectively) and still had to finish the job themselves.

In the first case he fired his lawyer, we coached him and he managed to get Minutes of Settlement at court, but the lawyer on the other side has stalled and stalled, refusing to list the property or draft the order and have it issued. I showed him how to have the order issued himself. He reported that lawyer to the Law Society.

The second case was mainly children's issues, which are never final. After paying $90,000, he fired that lawyer and he, too, managed to get Minutes of Settlement signed without any more lawyers' help. Six years later he is beginning to date, again, and his ex is now threatening to take him back to court. Go figure. Let him know she's blowing smoke and we'll help him this time if he needs some coaching. Both were referred to us from multiple sources. They will be using us (ELS) for all their future legal needs.

People who grew up in the 60s and 70s seem to think children these days are pu***es because they don't get to do some of the things we did. Most new rules and restrictions are actually the result of court decisions, the right decisions.

"Product liability" laws came about at the turn of the last century. The leading case involved a person that was poisoned by a soft drink. At that time bottles were made from materials that were opaque, you couldn't see what was inside the bottle. The poor plaintiff took a haul off a newly opened bottle and got a mouthful of putrid gunk. Now all pop bottles are see through. Cans now, too, have to meet the same health, safety and liability standards, because of the precedent these cases established.

This is called progress and although compliance can be a nightmare and some of the fun is gone, we have progressed. Kids aren't spoiled, they are protected. Thank a lawyer (lol).

The sun is out and the Real Estate market is starting to thaw. Interest rates are still a buzzkill, but people have waited so long to sell or purchase, putting a decision off until the market stabilizes, I think the summer is going to be a busy one. Good luck to all the sellers and buyers out there, find a good Realtor and let us help you close the deal.

Real estate professionals in Simcoe County have to contend not only with our seasonal markets, but interest rate fluctuations, pandemics, rule changes for mortgages and a great deal of uncertainty. Through all this they are expected to read the market, predict market prices and then compete like hell when conditions are right. It is not easy and they ride an emotional roller coaster just like their customers, the buyers and sellers. They become problems solvers when clients don't qualify for the homes they want, or when homes sit on the market too long to generate enough interest. Anyone that thinks they are overpaid just doesn't understand our market. Go with a pro.
