⚖️ **FAMILY LAW: MYTH vs FACT**

❌ **MYTH:** “If we separate, everything automatically gets split 50/50.”

✅ **FACT:** If only it were that simple… we’d have a lot more free time. ☕😂

There is **no automatic 50/50 rule** when dividing property after separation.

Every matter is different. The outcome can depend on things like:

🏠 What each person brought into the relationship
💰 Financial contributions during the relationship
👶 Parenting and homemaking contributions
📈 What happened financially after separation
🔮 Each person’s current and future circumstances

**The moral of the story?**

Don’t take legal advice from your mate at the pub, your neighbour’s cousin who “went through a divorce once”… or TikTok. 😉

Get advice about **your** circumstances.

Not the kind where you finally admit you ate the last Tim Tam. 🍫

In family law, disclosure means providing relevant financial information and documents so everyone can understand the financial picture.

❌ “My kids know what I want.”
❌ “Everything will automatically go to my spouse.”
❌ “I wrote it down somewhere.”
❌ “My brother will sort it out.”
❌ “I’ll deal with it when I’m older.”

🏆 **WHAT DOES “WINNING” LOOK LIKE IN FAMILY LAW?**

It’s not always getting everything you asked for.

Sometimes, winning looks like:

⚖️ Getting a fair outcome.
👨‍👩‍👧‍👦 Protecting your children from unnecessary conflict.
💰 Protecting your financial future.
🤝 Reaching an agreement without years of arguing.
🧘‍♀️ Finally having some peace of mind.
🚪 And being able to close the door on one chapter and move forward.

Because family law isn't always about **winning against the other person**.

Sometimes, the biggest win is **getting your life back.**

And that's a result worth fighting for.

"Adjournment" (noun)

Meaning: When a court matter is postponed or rescheduled to another date.

💬 In everyday language?
It's basically the court's version of saying...

"We'll circle back to this." 😅

An adjournment can happen for all sorts of reasons—more evidence is needed, documents aren't ready, a witness is unavailable, or the court simply needs more time.

The good news? An adjournment doesn't mean you've lost your case. It just means the matter isn't finished yet.

⚖️ Legal fact: Patience isn't just a virtue—it can be part of the court process.

🚫 MYTH: "If my ex cheated on me, they'll get less in the property settlement."

✅ FACT: In Australia, family law is generally no-fault. This means that, in most cases, the reason the relationship ended—including infidelity—doesn't determine how property is divided.

Instead, the Court considers factors such as:
✔️ The assets and liabilities of both parties
✔️ Financial and non-financial contributions made during the relationship
✔️ Future needs, including income, health and care of children
✔️ What is just and equitable in the circumstances

Every family's situation is different, so there's no one-size-fits-all outcome.

If you're unsure of your rights after separation, obtaining legal advice early can make a significant difference.
