We are delighted to be the Australian contributor for Chambers HR Internal Investigations 2026: A Chambers Global Practice Guide.

Our contribution explores the legal and procedural framework governing workplace investigations in Australia, from initial steps to interviews and fact-finding, procedural requirements and proof, and finally the handling of the outcome. It also examines developments in the use of person-centred and trauma-informed approaches to investigations, addressing psychosocial hazards, responding to gender based violence and more.

This resource offers valuable insights and useful guidance for HR professionals, in-house counsel and business leaders.

On Thursday 22 May, Workdynamic team members came together for Australia’s Biggest Morning Tea to raise funds for cancer research.
We shared delicious treats and raised a cup for all who fight and fought, and together we have raised $750. Workdynamic will match this figure, bringing our 2025 total to $1,500 for Cancer Council Australia 🍵

What happens if an employer has a valid reason for terminating an employee but falls short procedural fairness requirements when implementing the dismissal decision?

In the case of Paul James McAllister v Ahoy Club Fleet Management Pty Ltd [2024] FWC 2651, a ship’s captain was found to be at fault for a collision which caused serious damage to the ship and narrowly missed causing serious injury to one of the deck-hands.

The employer decided they could no longer trust the employee to safely operate their vessels but failed to provide an opportunity for the captain to respond to the reasons for the dismissal.

The employee filed an unfair dismissal claim and the employer was required to defend the dismissal decision and the process it had followed. Find out more about what happened in this case in our article: ‘Employer on collision course with procedural fairness' https://workdynamic.com.au/employer-on-collision-course-with-procedural-fairness/.
