Outgoings are one of the most common areas of dispute in retail and commercial leases. While many costs can be recovered, the key lies in how they are documented and disclosed.

Under the Leases (Commercial and Retail) Act 2001 (ACT), landlords can generally recover expenses tied to ownership, maintenance and operation of a building. However, recovery is only valid where the lease terms and disclosure statement clearly set out what can be charged and how it is calculated.

Where these requirements are not properly met, tenants may have grounds to dispute payments — and in some cases, recover amounts already paid over several years.
