Adero Law has commenced a class action in the Federal Court of Australia against Rebel Sport on behalf of current and former salaried managers across Australia.

The proceeding alleges that managers were regularly required to work significant unpaid hours, including before and after rostered shifts, during meal breaks, and outside of rostered hours including but not limited to: attending security call outs, preparing and amending rosters and completing the payroll for the store.

The class action also raises allegations relating to unpaid overtime, penalty rates and other entitlements under the General Retail Industry Award.

The matter forms part of Adero Law’s broader investigations into alleged systemic underpayment practices affecting salaried retail managers across Australia.

Current and former Rebel Sport managers who worked during the relevant period may be eligible to participate in the proceeding.

Adero Law is proud to mark the official opening of our Melbourne office, an important step in the continued growth of our national presence and our commitment to supporting clients across Australia.

The evening brought together clients, colleagues, members of Counsel, barristers, and friends of the firm to celebrate this milestone. The event was opened with an address by Rory Markham, Managing Principal at Adero Law, reflecting on Adero’s journey to date and the opportunities ahead as we expand into the Victoria.

A special thank you to his Honour Judge Michael Wise of the County Court of Victoria for delivering the keynote address, and to Cate Dealehr, Special Counsel at the Australian Legal Costing Group, for joining us on the evening.

It was a fantastic opportunity to connect with our network, strengthen relationships, and share in what this next chapter represents for the firm.

The proceeding concerns allegations of underpayment of salaried employees, including unpaid overtime, penalty rates, and work performed outside rostered hours.

Adero Law has filed a class action against Kmart Australia in the Federal Court, alleging employees were not paid their full entitlements under the General Retail Industry Award and the Fair Work Act.

The claim includes unpaid overtime, penalty rates, and allowances.
The proceeding is brought on behalf of current and former salaried employees and is estimated to potentially affect approximately 1,510 to 2,113 employees across Australia.

Kmart managers have alleged they were routinely required to work "well beyond" their rostered hours without receiving overtime rates, penalty rates, or prescribed allowances.
