RTO mandate? Or a sneaky way to get you to quit without severance? 💼

Across Calgary, “Return to Office” (RTO) mandates are everywhere. But here is the legal reality in Alberta: Forcing a remote employee back to the office can actually count as constructive dismissal.

If remote work was a fundamental part of your job, and if your employer did not have a valid policy in effect, your employer cannot suddenly change it without your consent or proper notice. Doing so might mean you are legally entitled to walk away with full severance pay.

Did your employer tell you that you “forfeit” your bonus because you were let go? They might be wrong. ✋🏼🛑

In Calgary, many employers try to use the phrase “must be actively employed on the payment date” to avoid paying out bonuses during a termination. But in Alberta, the courts look closely at the exact wording of your contract.
