Understanding Zambia's New Non-Bailable Offences:

Zambia's criminal law has recently undergone a significant change. The Criminal Procedure Code (Amendment) Act No. 4 of 2026 has expanded the list of non-bailable offences to include crimes such as r**e, defilement, in**st, stock theft, theft of medicines, theft of strategic minerals, and damage to critical infrastructure.

What does this mean?

Individuals charged with these offences will generally not be eligible for bail while awaiting trial. This amendment has important implications for accused persons, their families, and the broader justice system.

Understanding changes in the law is essential, especially when they directly affect personal rights and liberties.

Happy World Intellectual Property Day!

Many people believe copyright only exists after registration. In Zambia, copyright arises automatically once an original work is created under the Copyright and Performance Rights Act. However, enforcement is where challenges arise. Without clear proof of ownership, it becomes more difficult to take action if your work is used without permission.

In practice: you own your work from creation but proving ownership is key to protecting it.

Probation is not open-ended. Under the Employment Code Act No. 3 of 2019, probation is limited to 3 months, with the option of one extension.
In practice:
· It cannot run indefinitely
· Extensions must be agreed and justified
· Employees still retain basic rights during probation

There are patterns lawyers notice immediately.

• Agreements with unclear terms
• No written record of key discussions
• Payment terms that are vague or missing
• Deals based only on verbal understanding

These may seem manageable at first, but they often lead to disputes. Clear terms and proper documentation do not complicate things. They protect them.

Under the Employment Code Act No. 3 of 2019, redundancy must be based on one of three defined grounds under Section 55, being:
• The employer ceasing or intending to cease to carry on the business
• The business ceasing, diminishing, or expecting to cease or diminish the need for employees to carry out work of a particular kind
• An adverse change to the employee’s conditions of service without their consent

What this means in practice:
• Redundancy cannot replace disciplinary action
• There must be a clear business justification
• Proper procedure, notice, and payments are required

Getting this wrong can expose businesses to claims and avoidable risk. Before making that decision, it is important to understand the difference.
