I just want to commend my fellow attorney Lizelle Draai who has stood in for me during my medical leave (started 26 August due to end 10 October 2025). She is a very experienced conveyancer, but has navigated the intricacies of litigation in the last 2 weeks (and will do so for the period up to 10 October 2025 with Juanita Swart, our other attorney). You are as always in very good hands with L.Draai Attorneys Inc, a firm that specializes in estates and will drafting, estate/normal transfers, and estate, civil and criminal litigation. Don't forget our free Tuesday morning sessions at our offices from 9am to 12.30 for any wills, estates and property transfer-related queries and/or drafting. We have three attorneys (including a conveyancer) on duty that can be of assistance to you with one of them having recently completed the course in deceased estates practice at UNISA. Another year has come and gone and wish you an amazing Christmas and all the best for 2025. Our office closes on Friday (13 December 2024) and reopens on 6 January 2025. We assisted a young man recently on a pro bono basis to obtain a suspended sentence after being an awaiting trial prisoner for 4 months without him being able to raise bail. Kudos to Juanita Swart who handled this matter.

I listened to a senior executive from a well known financial institution yesterday saying that attorneys are not always required in the process of drafting a will. You can do your will online using a properly legally drafted template, which is free. However, the financial institution will be appointed as executor/s later (upon your death) and they will be paid the executor's fees. I would still opt for the experience of an attorney to draft your will and there are so many opportunities for free wills these days in any event (with wills free month and our free Tuesdays). Your surviving family also have the option to go to whoever they want to wind up your estate and negotiate fees.

We recommend that you be prudent during Wills Week 2024 to choose attorneys to prepare your last will and testament and not entities and/or individuals that are not registered with the Legal Practice Council. We continue to offer a free service in that regard on Tuesday mornings from 9am to 12.30 (by appointment, call 021 697 3438). We have been involved in wills litigation where wills were not properly drafted and/or executed and the cost of bringing applications to court to remedy such situations have been prohibitive.

The team is also a multi disciplinary one so we cover several areas of expertise including conveyancing, litigation (both civil and criminal) and estates/wills. We are able to support and learn from each other so that you will not be left stranded when you require help. Recently, we assisted a client on a criminal matter within one appearance and without the necessary experience in this field, the client could have been behind bars for even longer.
