Thinking of buying or selling property? Don’t rely on verbal promises, they can cost you big time. A recent Supreme Court of Appeal case shows why: even if someone promised to “give back” a share of a house, if it’s not in writing, the law won’t enforce it.

🏡 Some families in South Africa don’t lose their homes because of debt…

They lose them because no one did the paperwork after death.

When someone passes away and there’s no will or estate reported, everyone keeps living there as if nothing happened. Years go by… and then someone wants to sell, transfer, or fix the property and that’s when the shock comes.

Legally, no one living there owns it. The estate should’ve been reported within 14 days of death. If it wasn’t, everything stays frozen: no access to bank accounts, no transfer of property, no authority.

This is when family disputes often start cousins, siblings, even strangers asking questions. Homes that seemed secure suddenly become battlegrounds.

💬 Ask yourself: If someone in your family passed away years ago, was the estate ever reported? Or are you living in a house that’s still legally in someone else’s name?

⚠️ Think your digital will is safe? Think again.

If your will is saved on your phone or laptop, it could be completely invalid, even in 2026.

In South Africa, electronic wills are not automatically legal.
If your will doesn’t meet all the formal requirements, it can be rejected, leaving your loved ones with uncertainty, delays, and costly legal battles.

A valid will must be:
✏️ Written on paper
✏️ Signed at the end
✏️ Signed in front of two competent witnesses
If it has multiple pages, every page must be signed.
And your heirs cannot act as witnesses, otherwise they risk losing their inheritance.

Many assume electronic signatures are enough. They’re not for wills.

In a recent High Court case where an electronic will was only accepted after a costly legal battle, all of which could have been avoided.

Protect your family and your legacy. Use pen and paper, and make sure your will is done properly.
