How much does probate actually cost in Massachusetts? It’s a question many families don’t think about until they’re already dealing with an estate.

And the cost isn’t always just one court fee. Depending on the estate, there can be attorney fees, court costs, administrative expenses, and other costs associated with settling the estate.

This is also why simply having a trust isn’t enough. If the trust isn’t properly funded, assets can still end up going through probate. Understanding how your estate is structured can make a big difference in what your family may have to deal with later.

You can spend a lifetime building wealth for your family. But when estate taxes come due, where will the money actually come from?

For Massachusetts families, the estate tax threshold is just $2 million. And if most of your wealth is tied up in a home, real estate, investments, or a family business, your estate may have a tax bill without having enough cash to pay it.

That’s where an Irrevocable Life Insurance Trust (ILIT) can come in.

In our latest blog, attorney Michael Monteforte Jr. explains how an ILIT can use life insurance to create liquidity for your estate, and why ownership of the policy matters.

Probate isn’t a one-day court appearance and a quick distribution of assets.

Even when everything goes smoothly, probate can take 18 to 24 months to complete. And if there are issues with paperwork, missing assets, creditor claims, taxes, real estate, beneficiary disputes, or court delays, an estate can remain open for years.

That’s a lot of time for your family to spend dealing with the estate instead of moving forward.

When comparing estate planning attorneys, it’s easy to focus on the price and how many documents are included. But those two things don’t necessarily tell you what you’re actually getting.

So before choosing an estate planning attorney, it’s worth asking a bigger question: What happens after the documents are signed?

If this raised questions about your own estate plan, you can connect with our team for a free consult call!
