Huge win in the Delaware Supreme Court!

The firm’s managing partner, Adam Wasserman, secured a major victory for our client, opening the door to $1 million in insurance coverage after she was seriously injured in a car crash.
Her insurance company denied coverage under her business auto policy simply because she was driving her own personal vehicle. After the Superior Court ruled against us, Adam appealed and argued the case live before the Delaware Supreme Court sitting en banc.

The Supreme Court reversed, holding that the vehicle-based exclusion was unenforceable under Delaware law because underinsured motorist coverage follows the insured, not the vehicle.

This is a tremendous result for our client and an important victory for Delaware insurance consumers!

Even minor damage is worth documenting. 📸

After an accident, take photos whenever it is safe to do so. Try to capture more than just the visible damage to your vehicle. Photos of both vehicles, license plates, the accident scene, road conditions, traffic signs/signals, skid marks, debris, and any visible injuries can help preserve details about what happened.

Don’t assume that minor vehicle damage means an accident wasn’t significant. Photos taken at the scene may become important later when memories fade, vehicles are repaired, or questions arise about how the accident occurred.

When in doubt, take the photo!
