Did you know sellers can still help pay your agent's fee? A lot of people think that went away — it didn't. What changed is how it has to be documented.

Buyer's agent compensation used to be automatically advertised through the MLS. Now it's negotiated deal-by-deal, right in the contract.

Here's the part that concerns me: some agents are skipping the proper process and just writing custom compensation terms into a section of the contract called "Special Provisions." That section is legally limited to factual details — not custom legal terms. Doing this is considered practicing law without a license, and it can mean fines, disciplinary action, or terms that don't actually hold up the way everyone assumed they would.

If you're buying or selling, you don't need to be a contracts expert. Just ask your agent one question: "How exactly is compensation being documented in my contract?" If the answer isn't clear, that's worth digging into before you sign.

I spent years as a loan officer before becoming an agent, and I've built my business around knowing these contracts inside and out. I'm always happy to walk anyone — client or not — through their contract line by line to make sure everything is compliant and they're being represented fairly. Just send me a message.
