Having a potential claim against another company does not automatically mean pursuing it is the best business decision.

In this clip from The Business Bar, Gary shares an example from his representation of a General Electric subsidiary following the pipeline spill in Marshall, Michigan.

His client had inspected the pipeline, which was owned by Enbridge. The two companies had potential claims against each other over responsibility for the failure.
They made a business decision to work together and present a coordinated defense to the other plaintiffs suing them. ๐Ÿค

Itโ€™s a perfect illustration of why litigation strategy requires a broad view of the clientโ€™s interests. The legal arguments matter, yet so do the business realities surrounding the dispute.
