Power of Attorney vs. Conservatorship: Do You Know the Difference?

Imagine your parent has a stroke and suddenly can’t manage their finances.

If they already have a Durable Power of Attorney, a trusted family member may be able to step in and handle the bills, accounts, and other financial matters - without going to court.

But without one? That same family may have to petition the Probate Court for a Conservatorship, potentially facing months of proceedings, court oversight, attorney fees, and ongoing reporting.

Same family. Same crisis. The difference may be one document signed before the crisis happened.

A Conservatorship absolutely has its place, and sometimes it’s the only option. But planning ahead can give you more control over who makes decisions for you - and spare your family a much more difficult process later.

Most California families guess wrong about the cost of Probate. The number is almost always higher than they expect

California sets Probate fees by statute, calculated on the gross value of your estate, not your equity. A home appraised at $900,000 with a $600,000 mortgage still generates fees based on the full $900,000. And that statutory fee applies to both the attorney and the Personal Representative, two separate fees, drawn from the same estate before any beneficiary receives a dollar.

That is before court filing fees, appraisal costs, publication requirements, and bond premiums are added.

A properly funded Living Trust avoids the court process entirely, meaning the statutory fee schedule never applies to the assets held within it.
