David Bliven, Westchester Divorce & Family Law Attorney - Bronx Divorce & Family Law Attorney: “How Do Prenups Work in New York? What They Can and Can’t Do” *** If you appreciated the information in this video, please share, “like,” subscribe & follow. Thank you! ***

“Thinking prenups are only for the wealthy? Think again — modern prenups protect everyone.”
“Prenups used to be a taboo topic. Today? They’re one of the smartest financial planning tools available.
I’m David Bliven, Bronx & Westchester Family Law Attorney, and here’s exactly how prenups work under New York law.
1. What Prenups Can Do:
Protect premarital assets.
Protect family businesses.
Define separate vs. marital property.
Protect future income.
Protect real estate you own.
Clarify financial responsibilities.
Limit or define spousal support.
These protections save families millions every year.
2. What Prenups Cannot Do:
Predetermine child custody.
Predetermine child support.
Encourage divorce.
Waive certain rights completely.
Anything that harms a child’s best interests is unenforceable.
3. When Prenups Are Most Useful:
Second marriages.
When one spouse has significantly more assets.
Family businesses.
Inheritances.
Unequal incomes.
High-earning professionals.
Property owners.
4. Are Prenups Enforceable?
Yes — if drafted correctly.
To be enforceable, prenups must be:
Voluntary.
Transparent (full financial disclosure).
Fair at the time of signing.
Properly acknowledged.
Clear and specific.
Poorly drafted prenups can — and do — get thrown out.
5. Should You Get a Postnup?
Even after marriage, a postnuptial agreement can:
Protect assets.
Clarify financial expectations.
Create peace of mind.
Reduce conflict.
At the Law Offices of David Bliven, we create prenups and postnups designed to withstand court scrutiny and protect your long-term financial future.
If you’re considering a prenup or postnup, contact my office for a confidential consultation.”

“Divorce doesn’t end when the papers are signed—especially if you’re high income, a business owner, or have significant assets. Let’s plan your financial future now.
I’m David Bliven, Bronx & Westchester Divorce Attorney. You’ve settled your divorce, but now the real work begins—protecting wealth, preserving future earnings and guarding against future claims or risk. For high-income and high-asset individuals, post-divorce planning is critical. Here are three post-divorce steps smart high-income clients take:
Review the settlement structure — Is it tax-efficient? Does it protect your business or future income streams? You may benefit here from brining in a financial analyst and/or accountant on the issue.
Update your estate plan, trust documents, corporate or partnership agreements, or beneficiary designations — divorce may trigger unintended consequences if you don’t act. Many times, I recommend clients to have their divorce agreement reviewed by corporate counsel or an estate attorney to make sure the client's aims in the divorce gel with the advice given by those experts.
Maintain ongoing asset protection: in other words, adjusting business ownership, evaluating risk of future litigation, ensuring you’re not exposed to hidden claims or audits. Again, this is where advice not just from your divorce attorney comes into play, but also advice given by a wealth protection specialist or accountant specializing in forensic matters.
Remember: your divorce settlement should be the end of one chapter — not the beginning of financial regret. If you’re an executive, owner, or high-income professional and you want to secure your future post-divorce, let’s talk. I’m David Bliven, Bronx & Westchester Divorce Attorney, specializing in high-net-worth divorce and wealth-preservation strategy.”
