How Is Custody Determined In New York When Parents Are Divorcing Or Separated?

Custody of children is divided into two primary domains: physical and legal. Physical custody pertains to the parent with whom the child will primarily reside. Legal custody pertains to the authority of parents to make decisions for the child. The overarching legal standard for the award of both kinds of custody is the “best interests of the child,” in other words, “what would be best for the child,” not “what would be best for either parent.” Learn more here: https://mikedaileylaw.com/how-is-custody-determined-in-new-york-when-parents-are-divorcing-or-separated/
