Thinking about the EB-5 Immigrant Investor Program?

Here are a few important points to know before making an investment:

• EB-5 requires a qualifying investment that meets current program requirements.
• Eligible investments generally must create (or, where permitted, preserve) at least 10 full-time jobs for qualifying U.S. workers.
• Your capital must be placed "at risk" and guaranteed repayment is generally not consistent with EB-5 requirements.
• Meeting the minimum investment amount alone does not establish eligibility.
• Review the project carefully and seek guidance from qualified professionals before investing.

✈️ YOUR U.S. VISA EXPIRED. DOES THAT MEAN YOUR STATUS EXPIRED TOO?

Not necessarily.

A U.S. visa stamp is mainly used to request entry into the United States. Once admitted, your authorized stay is generally determined by your Form I-94 and whether you continue to follow the requirements of your immigration status.

✓ Visa stamp expired
✓ I-94 still valid
✓ Status requirements still being followed

You may still be lawfully present in the U.S.

🔹 Key takeaway: Visa expiration does not automatically mean status expiration. Always check your I-94.

⚠️ CAN YOUR SPOUSE’S COUNTRY OF BIRTH AFFECT YOUR GREEN CARD WAIT?

In some employment-based green card cases, it may.

🔹 Visa availability is generally based on your country of chargeability, usually your country of birth.
🔹 In certain cases, a married applicant may use the spouse’s country of chargeability through cross-chargeability.
🔹 This does not change the priority date, preference category, or underlying immigrant petition.
🔹 Specific legal requirements still apply.

A spouse’s country of birth may sometimes affect when an immigrant visa becomes available.

⚠️ YOUR EMPLOYER WITHDREW YOUR I-140 - DID YOU LOSE YOUR PRIORITY DATE?

🔹 An approved I-140 priority date may generally be retained for a later qualifying EB-1, EB-2 or EB-3 petition.
🔹 If the I-140 was approved for at least 180 days, employer withdrawal generally does not automatically revoke it solely for that reason.
🔹 Keeping the priority date does not guarantee a green card, continued sponsorship or employment authorization.
🔹 AC21 portability may apply when an eligible I-485 has been pending 180+ days.

Priority-date retention, I-140 withdrawal, and AC21 portability are separate rules and timing matters.

💡 O-1A VISA: ORIGINALITY ALONE IS NOT ENOUGH

✅ For the O-1A criterion involving original contributions of major significance, USCIS looks at more than whether the work is new.

✅ Applicants should show that the contribution was genuinely original and had meaningful significance or influence in the field.

✅ Evidence may include citations, adoption, implementation, commercial impact, independent documentation, measurable influence, or detailed expert letters explaining why the contribution matters.

📌 Key takeaway: Strong evidence should clearly connect the contribution to its documented impact.

Speak with our U.S. immigration attorneys to evaluate your O-1A profile.

🚨 DEVELOPING H-1B UPDATE: COGNIZANT & CLOUDERA

On September 8, 2026, the DOL Office of Inspector General posted: “Cognizant. Cloudera. H1-B processing suspended.”

🔹 What remains unclear?

• Which H-1B processing stage is affected
• Whether LCAs, USCIS petitions, or another step are involved
• Whether new or pending cases are impacted
• Which employees may be affected

⚠️ Key Takeaway
• No nationwide H-1B suspension has been announced
• Cognizant and Cloudera are specifically named
• More official guidance is needed

Potentially affected employers and workers should seek case-specific legal advice.

🚨 EB-5 AFTER SEPTEMBER 30, 2026: WHAT CHANGES?

The Regional Center Program is currently authorized through September 30, 2027, but an important protection reaches its cutoff one year earlier.

📌 WHY THIS DATE MATTERS

🔹 Qualifying Regional Center petitions properly filed with USCIS on or before September 30, 2026 are protected against a future program expiration.

🔹 Later petitions may still be filed while the program remains authorized, but they are not covered by this provision.

⏳ Considering EB-5? Evaluate your project, funding documentation and filing timeline early.

🔹 O-1A: A temporary nonimmigrant classification for individuals with extraordinary ability.
🔹 EB-1A: A permanent immigration pathway for individuals with extraordinary ability who meet the required evidentiary standards.
🔹 EB-2 NIW: A permanent immigration option for qualifying EB-2 applicants where the job-offer and labor-certification requirements may be waived in the national interest.

📌 Key differences can include sponsorship, self-petitioning, evidence requirements, job offers, and immigration outcome.

✅ The right pathway depends on your qualifications, goals, and circumstances.
