Attorney David Murray recently joined WFLA News Channel 8 On Your Side to discuss an important change to Florida’s car accident reporting law that drivers should know about.

Consumer investigator Shannon Behnken sat down with David to discuss the new Florida law raising the property-damage threshold for reporting certain car crashes to law enforcement from $500 to $2,000 — and what that change could mean for drivers after an accident.

Determining whether a car crash caused $2,000 in property damage isn’t always easy, especially with today’s vehicles. As David explained, once repairs involve advanced driver-assistance systems, monitors, sensors and calibration, “it’s going to take it over $2,000 very, very quickly.”

David also pointed out an important detail Florida drivers may not realize: “It’s not just $2,000 worth of damage to your vehicle. It’s $2,000 worth of damage to all of the vehicles and property involved.”

His advice after a crash? Document as much as possible. Take plenty of photos, exchange the required information and insurance details, and get contact information from witnesses. That documentation can become especially important if questions or disagreements arise later during an insurance claim.

An important issue for Citizens policyholders is headed to the Florida Supreme Court.

At issue is Citizens Property Insurance Corporation’s requirement that certain insurance disputes be resolved through mandatory arbitration before an administrative law judge at Florida’s Division of Administrative Hearings (DOAH), rather than through the traditional court system. That distinction matters.

For policyholders, this case raises important questions about what rights they have when they disagree with Citizens over an insurance claim, and whether requiring those disputes to proceed through the DOAH process is enforceable.

The Florida Supreme Court’s review will be one to watch for anyone involved in Florida property insurance claims. Its decision could have significant implications for Citizens policyholders and how their disputes are resolved going forward.
