CAN I DROP DOMESTIC VIOLENCE CHARGES?

The short answer is no. The DA can prosecute with or without your approval. We often hear spouses say that they were just trying to scare the other person. But once an allegation is made, the police will act and, in most cases, the prosecutor will follow through.

Obviously, a spouse recanting is helpful for the defense but it does not mean that charges will be dropped. Similarly, a spouse that is not cooperating, or is refusing to testify, makes the case harder for the District Attorney but it also creates a fight about which victim statements, if any, the jury can hear.

Some statements may be admissible even though they are hearsay and admitting them into evidence is arguably a denial of the defendant's Due Process rights. The DA also has to decide whether or not they want to prosecute an uncooperative victim. While the laws provide protections that generally prevent a domestic violence victim from serving jail time, that doesn't prevent a conviction.

The bottom line is that, despite what you may have been told, you can't just call the DA and drop charges.

⚖️ NOT GUILTY: LIL DURK ACQUITTED

A federal jury has returned a NOT GUILTY verdict for rapper Lil Durk (Durk Banks) in the highly publicized murder-for-hire case.

Federal prosecutors alleged that Durk helped orchestrate a 2022 plot to kill rapper Quando Rondo in retaliation for the 2020 death of King Von. Rondo survived the Los Angeles shooting, but his cousin, Saviay’a Robinson, was tragically killed.

The prosecution relied in part on testimony from Durk's former associates, including individuals who had entered guilty pleas and agreed to testify for the government. The defense maintained that Durk did not organize the shooting and argued that prosecutors could not prove his involvement beyond a reasonable doubt.

The case is an important reminder of a fundamental principle of our criminal justice system:

An accusation is not a conviction. The government carries the burden of proving every element of its case beyond a reasonable doubt.

You create the evidence so that the DA doesn't have to.

We see more defendant's giving harmful information to the police than see co-defendants turning on each other. If it is on your phone then the police will recover it. Don't talk to your boy, your girl or your momma. Don't talk about your case on the jail phone. Don't talk about it to your cellmate. Most importantly, don't talk to the police.

Nobody talks, everybody walks.

We appreciate the fair reporting from the local news media. False information has been spread on social media and there are clear attempts to turn this case into a political weapon. As you can see, even the statements in court are being contradicted by the evidence.
