You hear that knock at the door and they want to come in?

No warrant, no entry.

And you do not have to do anything. If they have a valid judicial warrant signed by a judge, they can and will come in.

But if it’s an administrative warrant? That does not give them the authority to enter your home.

Stay calm. Don’t argue through the door. Don’t consent to anything.

We get asked this all the time.

The script is not meant to stop you from getting pulled over, getting a ticket, getting harassed, or even going to jail.

The script is meant to protect and preserve everything for your defense later. That means protecting your Fourth, Fifth, and Sixth so your attorney can fight for you afterward or when they violated you.

That’s the purpose. Stay calm, stay polite, and stop giving away evidence.

In California, you provide your license, insurance, and registration.

After that? Stick to the script.

Never consent to searches. If they send you to secondary, you’ve got to go. If they tell you to get out of the car, get out.

But don’t do the field sobriety tests.

In California the smell alone is not probable cause to search your car if you’re 21 or older.

They have to couple it with something else like contraband in plain view or other evidence. But smell alone? Not enough.

If you’re under 21, different rules can apply.

Looking nervous, sweaty, shaking, or anxious is not reasonable suspicion of a crime. The Supreme Court has already held that.

First thing when they pull you over?
“Why’d you pull me over?”

They start asking questions?
“I’m not discussing my day.”

More questions?
“Am I being detained or am I free to go?”

If detained?
“I invoke the Fifth. I want my lawyer.”

Then what do you do? Shut up.

That’s the biggest DUI myth.

They’re already investigating you before the field sobriety tests even begin. Those tests are used to collect more evidence, and many sober people fail them.

In many states, roadside field sobriety tests before arrest are voluntary. Chemical tests after arrest are a different issue and can carry consequences depending on your state.

Know the difference between voluntary and mandatory. Stay respectful, don’t argue, never drive impaired, and never do the field sobriety tests.

That eye test is called HGN and most people have no idea what they’re even checking. They move a pen back and forth looking for certain eye movements they claim indicate alcohol use.

But fatigue, medications, medical conditions, flashing lights, and even doing the test incorrectly can affect the results.

By the end of the stop, they may have already decided whether they’re making an arrest. The roadside investigation is built to gather evidence, not clear you.

Counting backwards and alphabet tests are divided attention tests designed to make your brain do multiple things at once under pressure. Anxiety, stress, exhaustion, ADHD, age, or medical conditions can all affect performance.

And once you make one mistake, they write it down as a clue of impairment.
