In California, is there something called the “Why’d You Pull Me Over” law?

Yep.

When they pull you over, they’re generally supposed to tell you why they stopped you.

There are some carved-out exceptions, but the idea is that they should tell you the reason for the stop instead of making you guess.

And if they don’t?

Ask.

“Why’d you pull me over?”

Simple.

If you get pulled over and ultimately you’re asked to get out of the car, do you have to?

There’s a case called Pennsylvania v. Mimms that says officer safety allows them to order you out of the vehicle.

If you refuse, things can escalate quickly.

They can force you out.

That’s why we suggest just getting out of the car.

Getting out is cooperation.

You can comply with physical commands without answering investigative questions.

Little brother, if you’re pulled over and before an arrest they ask for permission to use a device to test for drugs, is that voluntary or mandatory?

It is voluntary.

They may ask to swab your mouth with a device that tests for a wide range of substances.

The key word is ask.

If it’s voluntary, you can decline.

Know the difference between something that is voluntary and something that is mandatory.

What happens next?

You might get a warning.

You might get a ticket.

You might even get arrested and taken into custody.

The script isn’t a magic shield that guarantees a certain outcome.

What it does is help you stop giving away information and preserve your defenses for later.

If they let you go, great.

If they give you a ticket, take it.

If they arrest you, you continue to remain silent.

Remain silent in the patrol car. Remain silent during booking. Remain silent while you’re waiting.

Stay silent until you talk to your attorney.

Can you fly with it?

You can if you want to.

But understand that it is illegal.

It doesn’t matter if you’re flying from one city to another within a legal state. It doesn’t matter if you’re flying from one legal state to another legal state.

The fact that both locations allow it doesn’t automatically make air travel legal.

Once you start flying, you’re dealing with a different set of laws and potentially both state and federal consequences.

Depending on the circumstances, you could be facing misdemeanors, felonies, state issues, or federal issues.

Don’t assume legal-to-legal means legal to fly.

Know the risks before you travel.

You’re at home and hear pounding on the door.

They say they have a warrant.

You ask to see it, and it’s an administrative warrant.

What does that mean?

There are different types of warrants.

If it’s a judicial warrant signed by a judge, that’s a different situation.

But if it’s an administrative warrant and it says administrative, you do not have to let them in.

That’s why it’s important to know what you’re looking at before opening the door.

Just because someone asks doesn’t mean you have to volunteer access.
