Helpful legal tip: check your insurance policy and see where your car is listed as physically located. If your car is listed in one city/town, but the car is mostly in another city/town and damage occurs, the insurance company can DENY payout on the claim. Even worse your could get CRIMINALLY charged for insurance fraud for making that claim for damages. This can be accidental, maybe your policy automatically renews each year, whatever the case - just check that policy and get the access to the coverage you pay for!

Helpful legal tip: get GAP insurance when you buy a car with a loan. If you buy a car, new or used and have a loan on it, you should get GAP insurance. GAP insurance protects you when your vehicle is totaled and the value of the vehicle is less than what you owe on the loan. If you don’t have this coverage, you could OWE MONEY on a vehicle, you no longer have, because of an accident not your fault. Protect yourself from this situation! If you have a car loan, find out if you have GAP coverage. If you do great! If not, see if you can get it applied to your loan for extra protection or apply for a new loan with this protection. Accidents can happen at anytime, protect yourself and your 💰💲💰!

Helpful legal tip: Check out your COLLISION coverage. To start, check out your declaration page on your insurance policy. Its that page in the packet the insurance company sends you once a year that has a bunch of numbered boxes with values and rates next to it. In Massachusetts its titled “Coverage Selection Page” and Collision is item number 7. If you have coverage, there is a deductible with a value ($500, $1000, ect.) and a price next to it. That means if your car is hit by another car, your car rolls over, you hit a tree or you hit a pothole…you are covered. If the accident is not your fault you will get coverage from your insurance first and fast then your insurance gets reimbursed by the at-fault person’s insurance company. If the accident is your fault, you get coverage for your vehicle minus that deductible amount. All around it’s important to have this coverage no matter what. It is an additional expense and you don’t “need” it, but it can be very helpful and important! In the last few months, we have seen more accidents where someone did not have this coverage and the other person that caused the accident had no insurance, lapsed insurance or limited property damage coverage. Then there was little or no payout for the vehicle. That means NOTHING was paid for the value of the vehicle with the no coverage or lasped coverage. Protect yourself and make sure you have the right coverage for your needs!

Helpful legal tip: if you drive for Uber, Lyft, DoorDash, the car insurance you pay for each month may not cover you when you get into an accident! Certain auto insurance companies exclude protection in an accident when you are involved in “livery” which is the service of transporting people or items for money. Check your policy to see if this exclusion applies to you! If it does call your insurance agent today and get the proper protection. Otherwise you could risk denial of coverage and personal liability if the accident was your fault. There are certain coverages given by Uber, Lyft and DoorDash, but it’s better to be protected than not.
