California Judicial Council posted today the newest probate forms, one new and several with updates.
Remember the law went into effect April 1st and applications to the court 40 days later.

Probate is the legal process of proving a will's validity and overseeing the administration of a deceased person's estate. It involves validating the will, appointing an executor (or administrator), and distributing the deceased's assets to beneficiaries according to the will or, in the absence of a will, according to state laws.

The new law dated April 1st, 2025 allowing heirs to use in California, a Small Estate Affidavit and avoiding a full probate up to $750,000 is now on the books for those who who own a primary residence.
This new change even allows that your love one was in a nursing home.
Still waiting for the Judicial Council of California, to post the updated form .
40 days must pass before filing .
My suggestion is to start the inventory and appraisal process asap.
The state Referee has up to 60 days to complete the process.
May-June should see increased filings with the California Superior Courts.
The current filing fee is $45 dollars and with estates exceeding the current $184,500 and up to $750,000 I suspect the courts will adjust the filing fee.
Our office can assist the heirs with the proper filings.

I checked this morning on the Judicial Council forms for the new April 1st Law Update on Small Estate Affidavit and the increase to the decedent's estate raising the value to $750,000 for the primary residence.

I am working today on a Small Estate Affidavit. The decedent's property is in Tuolumne County, and the Heirs live in Humboldt County.
