Shawnee Law Tip: Hey everyone! I wanted to share some important information regarding car insurance in Oklahoma. According to 36 O.S. § 941, insurance companies in our state cannot increase your premium, cancel your policy, or refuse to renew it just because you were involved in a car accident where you were not at fault.

This protection also applies when you have to make a claim against your own uninsured motorist (UM) or underinsured motorist coverage. If the other driver is at fault and either doesn’t have liability insurance or has less coverage than necessary to cover your bodily injury claims for medical bills and pain and suffering, the Oklahoma Insurance Code ensures your rates won’t be affected.

If your insurance company tries to increase your rates, cancel, or refuse to renew your policy under these circumstances, it could be considered bad faith insurance. If you find yourself in this situation, we can help you fight back.

Shawnee Law Tip: If someone is accused of public intoxication and their breath test shows a blood alcohol level below the legal limit of 0.08, they are not legally intoxicated. If this person is subsequently arrested for public intoxication, they may have grounds for a valid false arrest claim, entitling them to monetary damages from the arresting governmental entity. This situation is relatively uncommon because police officers are generally not obligated to administer alcohol tests when suspecting public intoxication. However, if they do conduct such a test, they must adhere to the results.

OK LAW TIP: In Oklahoma, other than a child in DHS custody, a parent can not voluntarily relinquish their PARENTAL RIGHTS and duties to a minor child, except when an ADOPTION case has been filed.
