One of the biggest misconceptions in domestic violence cases is:
“They don’t want to press charges anymore, so the case should go away.”

It is usually not that simple.

Once law enforcement and prosecutors become involved, the case is no longer controlled entirely by the person who originally made the accusation.

Someone can change their mind.
They can say they do not want the case prosecuted.
They can even recant what they originally said.
That does not automatically make the case disappear.

Prosecutors may look at other evidence, including statements, photographs, recordings, witnesses, 911 calls, body-camera footage, and what officers observed.

And if there are bond or no-contact conditions in place, those still need to be taken seriously unless the court changes them.

Domestic cases can become complicated very quickly.
Do not assume that reconciliation means the legal problem has disappeared.

There is a difference between cooperating and volunteering information.

If you are stopped, stay calm. Be respectful. Provide the documents you are legally required to provide, such as your driver’s license, registration, and proof of insurance.

But you do not have to turn the stop into an interview.

You do not need to volunteer:
“Where are you coming from?” “Where are you going?” “How much have you had to drink?”
And roadside field sobriety exercises are generally voluntary.

You can be polite without providing information that may later be used against you.

One important distinction: Georgia’s state-administered chemical testing after a DUI arrest is a different issue. Georgia’s implied-consent rules can impose serious license consequences for refusing those tests.
Be respectful. Be calm. Know the difference between cooperation and volunteering evidence.

If a detective calls and says, “We just want to hear your side of the story,” your instinct may be to explain everything.

That can be exactly when you need to slow down.
You may not know what evidence they already have.
You may not know what someone else has said.
And you may not recognize which seemingly harmless detail could become important later.
If you are already under suspicion, talking more does not necessarily talk you out of it.

Sometimes the smartest answer is:
“I’d like to speak with an attorney before answering questions.”

Then let your attorney communicate with investigators strategically.

You only get one first version of your story. Make sure you understand the situation before you give it.

After a DUI arrest, there may be two different problems developing at the same time:

The criminal case.
And what happens to your driver’s license.

In Georgia, an Administrative License Suspension hearing request generally must be submitted within the required 30-day appeal period. If that deadline is missed, the right to challenge the administrative suspension can be waived.

That is why the first few decisions after a DUI matter so much.

Waiting until your first court date to start asking questions can mean important deadlines have already passed.

If you have recently been arrested for DUI, get clear on your options early.
A bad night does not need to become a year of avoidable problems.
