Getting stopped for a DUI can be scary if you don't know know what to do. If you are pulled over and an officer states that they smell alcohol emitting from your vehicle or from you, more than likely, you WILL be arrested for a DUI. It is best to keep your mouth shut, refuse all tests and state that you wish to remain silent and want an attorney. DO NOT perform field sobriety tests, DO NOT give breath or blood, DO NOT give them the evidence that they need to convict you. You have the right to refuse all tests and you should exercise that right. If you are asked for your license, proof of insurance, and/or proof of registration YOU MUST provide that information under Georgia law.

What is Nolo Contendere? And what does it mean for traffic offenses in Georgia? Sometimes referred to as a "Nolo plea", this tool can be very helpful if you wish to avoid points on your license.This plea essentially entails that you are not pleading guilty but you are not contesting the State. You accept the States punishment, i.e. fine amount and maybe defensive driving, but you avoid points on your license. Georgia residents are entitled to a Nolo Plea every 5 years.

Georgia's Move Over law can carry a hefty penalty for drivers. $500+ in fines and a whopping 3 points on your license and insurance.
The "Move Over" law requires drivers to move over if an emergency vehicle is on the side of the road. And if too congested, then slow down to below the posted speed limit AND more importantly be able to STOP.
This means that even if you are going below the posted speed limit of 70, if you pass by an officer on the side of the road and you would cause injury or death to the officer if he stepped into the lane, then you are going TOO FAST.
Our law firm recommends that if you cannot move over lanes, slow down so that your speed would not even ruffle the officers pant leg.
