Driving for a Gig Platform? Know When Your Auto Insurance Applies

Do you know that when you drive for a gig platform, there may be times when your personal auto insurance does not apply? Drivers for platforms such as Uber, Lyft, DoorDash and other app-based services may spend part of their day waiting for a request, accepting a ride or delivery, or actively transporting a passenger or making a delivery. Each stage can raise different insurance questions when an accident occurs.

Many gig drivers do not realize that accepting a ride or delivery, or entering a particular phase of the gig work, can affect what insurance coverage is available to them. Unless you have the appropriate coverage, rider or endorsement, your personal auto insurance may not provide coverage during certain phases of your work for the app.

Our client accepted a gig assignment and was driving to pick up the order when, while waiting in traffic, they were hit head-on. They had not picked anything up yet, but the gig app was active.
The other driver was at fault but carried only California minimum insurance limits of 30/60/15, $30,000 per person, $60,000 per accident and $15,000 for property damage.

To our client's surprise, their personal auto policy did not provide coverage for the accident. As a result, they were left paying for the tow and storage of their vehicle, rental expenses and the portion of their auto loan that was not covered by the other driver's property damage limits.

Their injuries were also extensive, and the other driver's insurance limits were quickly exhausted. Because our client's own policy did not provide coverage for the accident, and the gig platform did not provide applicable underinsured motorist coverage under the circumstances of this accident, they were left with medical expenses that could not be recovered from the at-fault driver's insurance.
If you drive for a gig platform and are involved in an accident, do not assume that your everyday auto insurance covers you simply because you have an active policy. Know when your coverage applies and when it does not. Make sure you have the appropriate coverage and limits needed to protect you.

We always say, “An insurance company is only going to take your injuries as seriously as you do.” So, what does that mean?

The best way to protect your health and your claim is to get evaluated and follow through with the care you need.

Most people know what to do immediately after a car accident: check for injuries, call 911, exchange information, and take plenty of photos. But there is one decision many drivers overlook.

Where their vehicle is towed.
If your car isn't drivable, most people assume the tow truck at the scene is their only option. In many situations, it isn't. If it's safe and practical, having your vehicle towed to your home instead of a storage yard can make the insurance process easier and may help you avoid unnecessary towing or storage charges.

If you have roadside assistance, call them after calling 911. Whether it's through a membership organization, your insurance company, or a credit card, your towing benefit may cover the cost of taking your vehicle home.

If law enforcement needs the roadway cleared and you can't wait for your roadside assistance provider, ask the tow truck driver if your vehicle can be taken directly to your home. The Most Important Auto Coverage You Hope You Never Need: Why UM/UIM Matters

Imagine you're stopped in traffic when a distracted driver crashes into the back of your car. At first, you think you're okay. But by the next morning, you realize you’re not. A doctor visit turns into physical therapy, medical bills, and missed time from work. Then you discover the driver who caused the accident carried only the minimum liability insurance required by California law. Suddenly, your biggest concern isn't just recovering from your injuries, it’s whether there is enough insurance to cover them at all.

Unfortunately, this happens more often than people realize. Many California drivers carry only the minimum required coverage: $30,000 per person and $60,000 per accident. The person who hits you may have insurance, may have done nothing wrong before that moment, and may still not have enough coverage to pay for the harm caused. Medical expenses, lost wages, and rehabilitation costs can quickly exceed those minimum limits.

That's exactly why Uninsured Motorist (UM) and Underinsured Motorist (UIM) coverage is so important. Understanding How to Properly Document Your Traffic Accident
If you are involved in a traffic accident in California, you might be surprised when responding law enforcement officers hand both drivers an "Information Exchange" card and leave without writing a formal police report. This is a standard and practical procedure for busy departments. When a collision appears to involve only property damage, officers frequently treat it as a civil matter between motorists so they can remain available for urgent emergency calls.

While an information exchange card is a helpful starting point, having an official report is always the preferred way to ensure accurate documentation for your insurance company. Overworked adjusters rely heavily on neutral third-party accounts, and without a formal report, resolving a claim can take significantly longer as insurers work to verify the details of the event. At Edzant Price LLP, we frequently see how a missing police report can complicate an otherwise straightforward insurance claim.

Recently our firm represented a client involved in a very heavy collision. Officers did show up to the scene, but because no one was transported away by an ambulance, they facilitated a quick information exchange and left without writing a formal report. The officers did not write down any bystander witness information, and no one formally documented our client's complaints of pain at the scene.

Even though liability for the crash was entirely clear and eventually accepted by the at fault carrier, the insurance company initially used this lack of documentation to attack our client's credibility. The insurance company argued that our client was not genuinely injured, completely ignoring the fact that family members took them to the emergency room that same evening when the adrenaline wore off. We fought back and ultimately secured justice for our client, but this case highlights exactly how insurance companies exploit these procedural gaps.

If you find yourself in this situation, you can respectfully request a formal report without disrupting the officer's demanding schedule:
Communicate your physical status clearly: If you are experiencing any symptoms like neck stiffness, back pain or dizziness, let the officer know. Documenting physical symptoms often shifts the department protocol toward filing a formal report.

Acknowledge their time constraints: Approach the interaction with a sincerely appreciative attitude regarding their workload. Clearly state that a formal report is needed to ensure accurate documentation for insurance tracking.

Request a dispatch log number: If the officer is simply unable to stay, politely ask for a CAD (Computer-Aided Dispatch) incident number. This takes just a moment for the officer and creates a reliable, unalterable digital footprint showing that law enforcement responded to the scene.

In the event officers must leave without generating a full report, you can take proactive steps to preserve evidence. If safe and appropriate, take clear photos of all vehicle positioning, all vehicle damage, license plates, and road conditions. Before leaving, document the name and contact information of any voluntary on-scene witnesses. You can then visit the responding agency’s local station or website to file a standard citizen's counter report.

If you have ever thought about buying a used vehicle, you're not alone. The savings realized buying used versus new can be substantial making buying used a tempting option. When the used vehicle also has some of the remaining factory warranty, it makes perfect sense to buy used. However, an unknown risk of buying used vehicles is that with few exceptions, the consumer has no lemon law protection.

A true Certified Pre-Owned (CPO) can only be sold by new car dealerships of the same brand. For example, you can buy a CPO Toyota Camry from a Toyota dealership, but you cannot buy a CPO Toyota Camry from a Honda dealership. The CPO is backed by the manufacturer, and the vehicle comes with a factory warranty. These vehicles consist of only about 20% of used vehicles at a new car dealership, so the CPO is considered a premium vehicle. As you would expect, the CPO vehicle also commands a premium sale price. It must be noted that while most used car dealerships advertise their vehicles as, "certified", these vehicles are never considered CPO vehicles for lemon law purposes.

Under California law, only new vehicles are protected under the lemon law. With just two exceptions, used vehicles have no lemon law protection even if the used vehicle is purchased with some of the factory warranty remaining on the vehicle. The exceptions are true CPO vehicles, and dealership courtesy or demonstrator vehicles.

Many new car dealerships have vehicles which are provided to a customer while their vehicle is being serviced, commonly referred to as, "courtesy vehicles." These courtesy vehicles are later sold to a consumer by the dealership. Vehicles driven by dealership employees are also sold to consumers. These vehicles, while technically used, are nevertheless considered new because title has never been transferred from the dealership to a consumer. As such, for lemon law purposes, these "used" vehicles are legally considered "new" vehicles thereby affording the consumer full lemon law protection.

Buying used, while financially sound, must be weighed against the risk of winding up with a problematic vehicle without lemon law protection. If buying used remains the preference, the savvy consumer will seek out only CPO vehicles, or dealership courtesy/demonstrator vehicles. Having lemon law protection is the equivalent of buying insurance. You will spend more money for the used vehicle, but the extra cost for lemon law protection always makes financial sense for the added value and security.
