Should children be allowed to testify in a divorce?
In Utah, children rarely speak directly to a judge. Instead, the court relies on a Guardian ad Litem, an attorney appointed to represent the child’s best interests. However, there is a push to allow these attorneys to represent exactly what the child wants, rather than just what the attorney believes is best. While Utah law says judges will listen to children once they turn 14, there is no clear process for how that happens without putting kids in the middle of a courtroom battle.
