What actually makes a medical malpractice case?

As Robert Travieso explains, think of it like a three-legged stool. For a potential claim to stand, three key elements need to be strong:

⚖️ Liability — Did a healthcare provider make a negligent error?

🔗 Causation — Did that error actually cause the patient’s injury, harm, or death?

📋 Damages — What harm resulted, and what damages could potentially be awarded for those losses?

Not every medical error automatically results in a viable medical malpractice claim. Evaluating how these three elements fit together is an important part of determining whether a case can be successfully pursued.

The case settled. But our work wasn't done.

Many people don't realize that after a medical malpractice or personal injury settlement, a health insurer may have a right to seek reimbursement for certain medical expenses it previously paid.

But that doesn't necessarily mean every dollar the insurer claims should come out of the client's settlement.

In a recent case, an insurer sought nearly $175,000 from our client's recovery. Our attorneys and in-house medical team reviewed the medical claims line by line—bringing both a legal and clinical perspective to determine which expenses were actually related to the malpractice and which were not. We challenged unrelated claims and negotiated the lien down to roughly $95,000.

That's roughly $80,000 more of the settlement remaining for our client.

For us, securing the settlement isn't the end of the job. Protecting as much of our client's recovery as legally possible is an important part of the work that comes next.
