Food for thought. Rob Mills asked me if I could defend this case. My believe I could. Many of us that try difficult cases, do an exercise called psychodrama. It is there, where we look out our biases, perceptions, etc and grasp them. Those who have trained with me, have heard me call this "own the ick" In a training in November, I got my colleague/student to get on his feet and walk with me discussing the things that were disturbing him in the case. A grandpa accused of sexually harming a grandchild. The event allegedly occurred years early.

In it we see Ross clearly to the side as Good's vehicle is in motion. I have seen that in another frame by frame video. However this evidence must be viewed against the Ross phone cam video. He clearly was at least startled and instinctively je**ed out of the way. That was his subjective perception. To defend Ross, if charged, given the milliseconds of reaction, his state of mind must be presented. I raised concern that his previous encounter with a vehicle striking him, is a hill that will have to be overcome. As I told rob yesterday, we would have to put ourselves into the shoes of the actor. Many may use this video to judge Ross' actions. However, this is after the fact and it is not delving into what was going on at the time of the action.

I knew of one in Maryland last year, where a disgruntled employee made a recordings of discriminatory material against his principal. That caused the principal to be fired and dragged through the mud. It took deeper analysis of the recordings to show that the breathing patterns were not human

I blogged on this case a few weeks ago where the case was dismissed due constitutional infirmities. This case was a misdemeanor and we do not suspect the constitution simply because the matter may be "small" When one is up against the strong arms of the government, there is nothing small. That client wrote a five star review. I am fortunate that clients appreciate the hard work we put in on our cases.

In that oath, we swore our commitment to upholding the U.S. and Michigan constitutions, to maintaining respect for our courts of justice and judicial officers, and to never reject the cause of the defenseless or oppressed.
As the elected officers of the State Bar of Michigan Board of Commissioners, we want all Michigan attorneys to know that we are concerned by any and all threats to the judiciary, the Constitution, and American democracy. SCAM ALERT OAKLAND COUNTY JAIL

Just got a call from my client's dad (yes early riser) My client was sentenced to 100 days and went in on Wednesday. His dad gets a call from a "sergeant" yesterday telling him there is a program for early release due to overcrowding. He had to pay $2800 to get on a tether. The scammer had very specific information on my client's employment. The scammer directed the dad to a bitcoin machine near his home. Money paid. The OCSD has an alert on their website

Today in a courtroom in Macomb County, the 5th Amendment right to due process of law prevailed. The issue was rather simple and frankly one we do not see as much in the modern era of technology. I filed a Motion to Dismiss a case on the grounds that 911 recordings were not preserve. The 911 recording would have shown that my client was the caller and the so called "victim" (I do not use that word, I use 'complainant) was the aggressor. On the body camera, which remarkably was preserved, my client is seen telling the police that the complainant was the aggressor.

The prosecutor put the detective in charge on the stand. He agreed that preserving evidence was essential in cases and that 911 evidence is the type of evidence that must be preserved, He tried to flimsily state that the 911 recordings are destroyed unless demanded after 90 days. I said flimsily because he was not the proper witness on evidence preservation and the policies of the Macomb County Sheriff Dept on the topic. So the judge struck that line of testimony My judge was a former defense attorney and knows that evidence flows in at different times. I made sure to argue in closing that preservation of evidence does not have some magical timeline that relieves the government of its burden to preserve evidence .

The Judge was seriously troubled that the evidence, which the prosecution conceded was exculpatory, was not preserved. She agreed with my analysis that Federal Supreme Court law classifies that evidence as the type that must be preserved. She also agreed that it would be impossible for the jury to assess the credibility of the complainant without this evidence That is one of the prongs necessary to grant a dismissal.

Bottom line the Constitution was alive and well in a Macomb County courtroom today.
