Mold in homes is a serious issue the country is increasingly confronting. The Wall Street Journal recently reported on homeowner lawsuits against builders involving alleged mold-related illnesses.

These disputes can be difficult, contentious, and highly fact-specific.

For Texas homeowners, mold may be more than a repair issue. Depending on the facts, the questions may involve construction or repair work, warranties, disclosures, contracts, insurance, and evidence linking a condition to the claimed loss. Liability is never automatic.

The central questions are often about proof: Where did water enter the property? What work was performed? What do the construction records, inspections, testing, and communications show? Where illness is alleged, can qualified evidence establish the claimed exposure and harm?

Timing matters. Texas residential construction-defect claims can involve pre-suit notice and inspection procedures, while contracts and filing deadlines may affect the available path forward.

Before repairs or remediation change the conditions, documentation and preservation matter: photographs, records, communications, inspection materials, and appropriate professional evaluation.

Meet Marty Gatens, Richard Hood, Alex McClintic, and Josh Davis—four outstanding attorneys who bring their own experiences, strengths, and perspectives to our work for Texas tenants, homeowners, and families.

They also have something special in common: every one of them is a graduate of The University of Texas School of Law. 🤘 Richard and Josh are also U.S. Army veterans whose military careers included service in Afghanistan.
