Turner v. Louisiana, 379 U.S. 466 (1965), is a landmark decision by the United States Supreme Court that underscores the importance of an impartial jury in criminal proceedings. The case involved Wayne Turner, who was convicted of murder in Louisiana under circumstances that raised significant due process concerns. The core issue centered on the involvement of deputy sheriffs as both prosecution witnesses and custodians of the jury, potentially compromising the jury's impartiality.

If the police refuse to permit a driver the right to independent chemical test in a drunk driving case, there is no remedy, but the driver might be able to have the jury instructed that the police violated the driver's right to a separate test. 911 call and a traffic stop in Shiawassee County leads to a DUI arrest. I challenged the stop, and the trial court judge ordered the prosecutors to produce witnesses. Trooper was very cool. He even offered to do a TikTok with me! Haha, I told him he should look at my content first. Eventually the issues boiled down to weaving within the lane, trespass, and community caretaker function. Judge reviewed the evidence and CASE DISMISSED!!!

Coolin With Colin picked up a court hearing I had before Judge Elizabeth DiSanto the other day in the 27th District Court in Wyandotte, Michigan. The 5th Amendment right to remain silent applies at a bond hearing. Asking a client to incriminate himself at that hearing is inappropriate. Check out how I handle this issue on an OWI case. This video is edited and redacted, but I want to thank Coolin With Colin for granting permission to use this here on my TikTok.
