“I DIDN'T KNOW IT WAS ILLEGAL!”

We've all heard it. But in California, that excuse usually isn't enough. 👀

There's a legal concept called mistake of law—when someone knows what they're doing but is mistaken about what the law allows.

Generally, ignorance of the law is not a defense.

Because otherwise:

“I didn't know drunk driving was illegal.”
“I didn't know stealing was illegal.”
“I didn't know I couldn't do that.”

…would become everyone's defense. 😂

BUT there are limited exceptions. For certain specific-intent crimes, an honest, good-faith mistake about the law can sometimes affect whether the required intent existed.

So the answer isn't always simply “yes” or “no.”

The unfortunate truth is, jails and prisons are full of innocent people. Even if you are completely innocent, any lawyer would highly advise you AGAINST speaking to the police. Let your attorney do the talking fro you.

Your intent may be an important fact... but it doesn't automatically mean there are no criminal consequences.

In California, prosecutors may look at what you intended to do, what you knew, how dangerous your conduct was, and whether your actions caused someone's serious injury.

For example, someone might not intend to k*ll anyone while street racing or engaging in extremely reckless conduct. But if that conduct causes a fatal crash, the fact that the death wasn't intended doesn't necessarily end the case.

⚠️ Important: Not every accident is a crime, and not every accidental death results in a felony. The exact charge depends on the facts and the elements prosecutors have to prove.

If someone knowingly does something dangerous—like texting while driving—and their actions cause someone to get seriously hurt, they could still face criminal consequences.

Because of the currently ongoing Lindsay Clancy trial, I have been asked a lot about the insanity plea, and what it means.

A common belief is that the insanity plea means the defendant just walks off, scoff free, and continues living their lives. But, that’s not the case at all.
