Miot v. Trump: Court Denies Government Stay, Preserves TPS for Haitians

On March 6, 2026, the United States Court of Appeals for the District of Columbia Circuit denied the government's emergency motion for a stay pending appeal in Lesly Miot v. Trump, thus preserving Temporary Protected Status (TPS) protections for Haitian nationals while the litigation proceeds. 26-5050, (D.C. Cir.). The court agreed with the district court's finding that Haitian TPS beneficiaries, if returned to Haiti, would be vulnerable to violence amid a "collapsing rule of law" and would lack access to essential medical care.

As a result, Haitian TPS beneficiaries remain protected from detention and removal and continue to be eligible for employment authorization at this time. Individuals with pending TPS applications likewise remain protected from detention and removal and remain eligible to obtain employment authorization. The stay will remain in effect unless the government obtains a stay from the Supreme Court or until the case is resolved on the merits in federal court.
