🏑 Barreau Legal Property Tax Update

Florida lawmakers have approved a proposed constitutional amendment that could appear on the November 2026 General Election ballot. If approved by Florida voters, the amendment would eliminate property taxes on homestead property in Florida.

As with any proposed constitutional amendment, there are important legal, financial, and policy considerations that will be discussed in the months ahead. The proposal is not yet law and must first be approved by Florida voters before taking effect.

Barreau Legal will continue to monitor developments and provide updates to help keep our community informed.

If postsecondary education is part of your family’s future, estate planning can help support those goals in a thoughtful and organized way.

There are several tools families may consider.

A gifting trust can hold and invest money or property for beneficiaries while offering flexibility and control. A health and education exclusion trust may help support education or healthcare costs across generations while also incorporating charitable planning. A revocable living trust can include provisions to fund a child’s or grandchild’s education while allowing you to update the plan during your lifetime.

Families may also consider 529 plans, Coverdell Education Savings Accounts, or UTMA/UGMA accounts, depending on their goals and circumstances.

It is also important to remember that saving for education may affect need-based financial aid. How an account is owned can determine how it is reported and how it may influence eligibility.

Traditional LTCI and hybrid life/LTC products may help cover care needs such as in-home care, assisted living, memory care, or skilled nursing care. These policies can provide dedicated funds, preserve assets for heirs, support spousal planning, and reduce reliance on family caregivers.

But every policy has limits. Some policies may not cover the care you assume is included, and modern policies often involve stricter health requirements and more conservative pricing.

Whether long-term care insurance is right for you depends on your assets, health, budget, family responsibilities, and long-term planning goals.

Long-term care planning is not about expecting the worst. It is about preserving your choices and protecting the people you care about if life takes an unexpected turn.

A strong plan can help protect a spouse’s standard of living, preserve legacy intentions, maintain care choices, align long-term care with retirement planning, and reduce the burden on family caregivers.

No single strategy can protect against every risk. However, a thoughtful combination of tools may help, including insurance policies, flexible and accessible assets, public benefits planning, protective trusts, and clear family coordination.
