Your spouse thinks you would want one thing. Your adult children remember something different.

You’re in the hospital, unable to explain.

Without clear guidance, the people who love you may face difficult decisions—and disagree about what you would want.

An advance health care directive lets you name someone to make medical decisions when you cannot and document your wishes. Both matter: who can act, and what should guide them.

Then comes the conversation. Tell your chosen person what matters to you, and make sure they and your health care providers have a copy.

I help clients work through these choices before their families need the answers.

Save this as a reminder to check your directive—and talk with the person you’ve named.

You want your spouse to be secure. You also want your children to receive the inheritance you intend for them.

In a second marriage, those wishes deserve very careful attention—especially when either spouse has children from an earlier relationship.

Who would remain in the family home? How would your spouse be supported? What would your children receive, and when?

These conversations can feel sensitive. Working through them now can give everyone clearer expectations.

I help families put those wishes into a thoughtful estate plan, with attention to the people and relationships involved.

“My spouse knows my passwords. Is that enough?”

It’s a start—but what happens if the verification code goes to a phone you cannot unlock? Or your spouse needs help from the account provider?

Knowing a password doesn’t, by itself, establish legal authority to act. Your plan should address both the appropriate authority and the provider’s process for access.

At Duncan Law Firm, I help you think through these practical details so your family has clearer guidance if you cannot manage things yourself.

Q: We have a joint trust. Are we covered if we die days apart?

A: I would want to look at the trust and the assets with you before answering.

I ask what you want to happen if neither spouse can carry on. Then I check the trust’s survival requirements, backup recipients, asset titles, and beneficiary forms. A life insurance policy or retirement account may follow different instructions.

If you have children from different relationships, I also want to understand the promises you made to each other and to them. Those promises need to be reflected in the actual plan.

This is work we do while you can still explain your wishes. If your family later needs help, I can help them understand the choices you made and identify the next steps.

My article explains the questions I would bring to that review.

You named each other. But who comes next?

You probably pictured your spouse carrying on, paying the bills, and caring for the people you love. It is understandable if the conversation stopped there.

If you die in the same accident or only days apart, the next step deserves its own plan. Does property pass to your spouse and then under their estate plan? Or does it go to the backup recipients you chose? Different assets can give different answers.

This week’s article explains survivorship clauses, the rules that can require someone to outlive you for a specified period before inheriting. It also shows why a joint trust and a life insurance beneficiary form need to be reviewed together.

You can give your family clarity about what happens next. Start with the question you may never have asked.

“Your child’s success does not make protection unnecessary. It changes the risks your plan needs to see.”

The plan should see the career, business, marriage, family, and future your child built, not just their age. This week’s article is about why those real-life factors matter when deciding how an inheritance should be protected.
