There is a lot of confusion following the August 21, 2026 Federal Court decision regarding visa processing for the 75 countries on the State Department Travel Ban.

This decision does NOT mean that the travel ban on Afghan nationals has been lifted. Even though the 75 Country Travel Ban restriction was struck down, the Travel Ban under § 212(f) was not. Afghan SIV and immigrant visa applicants should seek qualified legal advice about their individual circumstances before deciding whether to attend or postpone an upcoming interview.

Please share widely so Afghan families receive accurate information and understand what this court decision does—and does not—change.

I want to share some very important information regarding ma*****na and immigration.

Although ma*****na is legal under California law, it remains illegal under federal law. For non-U.S. citizens, using, possessing, purchasing, working in the ma*****na industry, or admitting to ma*****na use can have serious immigration consequences. These consequences may include denial of immigration benefits, inadmissibility, removal proceedings, or even denial of U.S. citizenship.

If you are not a U.S. citizen, it is important to understand that state law does not protect you from the immigration consequences of federal law.

Don’t fall for third-party scams. If you need to renew your passport, go to the official site: http://travel.state.gov/renew. The best way to know that you’re on the official U.S. Department of State site is to look for “.gov” at the end of the url. Do not be fooled by sites ending in “.com”, “.us”, or “.org” – they are NOT government sites and may charge you more to simply provide forms from our site or send us your application.

Reminder! The length of time an international visitor is allowed to stay in United States is determined by the Customs and Border Protection (CBP) officer upon your arrival, NOT your visa expiration date. To see how long you can stay, check your I-94 (admit until date) at i94.cbp.dhs.gov.

Passport PSA for U.S. Dual Nationals: U.S. citizens are REQUIRED to enter and depart the United States on a U.S. passport. This requirement applies equally to U.S. citizens, including children, who are dual nationals. Dual national U.S. citizens may NOT use their foreign passport to apply for an electronic travel authorization (ESTA). The Department of Homeland Security routinely denies or cancels ESTAs for dual national U.S. citizens. If you are a U.S. citizen or national and live abroad and plan to travel to the United States, make sure you do so with a valid U.S. passport. If your U.S. passport is expired or expires soon, renew before your trip! Passports should generally be valid at least six months after the date of entry to a foreign country.
