Your power of attorney is probably USELESS. Here's why.

Most people download a power of attorney form online and think they're protected.

But here's what they don't know:

→ Many banks REJECT generic POAs — they want their own form
→ A POA that doesn't specifically grant the powers you need is worthless in Florida
→ Florida requires VERY specific language for real estate transactions
→ If your POA isn't properly witnessed AND notarized, it's invalid
→ Some POAs don't survive incapacity (the exact time you need them)

A Durable Power of Attorney must be:
✓ Florida-compliant with all statutory requirements
✓ Specifically drafted for your situation
✓ Signed while you have FULL capacity

A Florida woman died with $1.2M in assets. Her family got $0. Here's what happened.

True story (details changed to protect privacy):

She had a will. She had life insurance. She even had a trust.

But she never FUNDED the trust.

Her house was still in her personal name.
Her bank accounts had no beneficiaries.
Her life insurance named her ex-husband.

Result?
→ Ex-husband collected $500K in life insurance
→ House went through 18 months of probate
→ Attorney fees consumed $85K
→ Her current partner of 12 years received NOTHING (unmarried)
→ Her children fought in court for 2 years

Florida intestate law is NOT what you think.

If you die without a will and you have children from a previous relationship:

Your surviving spouse gets HALF.
Your children from the other relationship get the other HALF.

Your spouse might not be able to keep the house.
Your spouse might not have enough to live on.
Your children could force the sale of the family home.

And if you have minor children together but no will?

The court appoints a guardian of the PROPERTY for your children's share.

Your spouse has to petition the court just to use YOUR money to raise YOUR kids.
