What happens to a house when the owner dies?

If the property hasn’t been set up to pass directly to someone through a trust, beneficiary/transfer-on-death deed, joint ownership, or another legal method, probate may be required before the property can be sold or transferred.

That’s something every property owner should understand — and something every real estate investor working directly with sellers should know.

When you’re talking with heirs or families dealing with an estate, understanding who actually has the legal authority to sell the property can save a lot of confusion and prevent a deal from getting tied up for months.

Question: Do you have a Trust set up for estate planning purposes?

Whose your executor? Are they still alive? Still able to carry out the duties . . . or too old or a victim of dementia?

Are your house, cars, bank accounts, brokerage accounts in the trust? Or maybe not? And should all your accounts have the trust as beneficiary?

Hmm . . . what about your LLCs, the entities that own your notes, rentals, businesses, are they in your trust? If you passed away today or were disabled suddenly, could someone run your company?

On Tuesday, September 8, Rebecca Auriemma joins us to walk through the legal side of protecting everything you've built.

Rebecca is an estate planning and elder law attorney with Anderson & Associates. You're an expert at investing in real estate. You've built a HUGE portfolio. You even have an estate plan in place, so it all passes to the right people.

You manage everything. Your spouse supports you, but she doesn't really have the ability to run it — and doesn't want to. She's busy managing the house and the the kids.

Now imagine you're starting to have trouble figuring out new things.

This AI everyone's using — Claude, ChatGPT — baffles you.

You're a little afraid to buy the next property, because you're not sure you'd make the right calls on the rehab.

You still want to make a few more big moves… but analyzing deals has just become too much.

You lock yourself out of the house.
You get lost driving - A LOT.
