Fault isn't always 50/50, and in Florida, where that line falls can decide everything.

Florida uses something called comparative negligence. If you're found more than 50% at fault for an accident, you could be barred from recovering any compensation, even if the other driver shares some of the blame.

This is exactly why insurance companies push hard to shift fault onto you. Knowing how fault is determined can make a real difference in your case.

Happy Monday, Orlando.

Recovery rarely moves in a straight line, and neither does a fresh start. Some days you'll feel strong, some days you won't, and both are part of getting back up.

Wherever you're starting this week from scratch, we're glad you're still moving forward. πŸ’ͺ

Walking shouldn't put your life at risk, but in Florida, it often does. Most pedestrian deaths in the state happen after dark, and high-traffic, tourist-heavy areas like Orlando see accidents at intersections, crosswalks, and parking lots more than most places.

Drivers who fail to yield, run red lights, or don't check for pedestrians before turning are often at fault, but Florida's comparative negligence laws mean fault isn't always simple.

If you were hit while walking, you have options, and we're here to help you sort through them.

Your damaged car is in the shop. Life in Orlando doesn't stop.

You still have to get to work, pick up the kids, run errands, live your life. But now there's a rental car question hanging over your head, and you're not sure who's supposed to be paying for it.

That uncertainty is exactly why we wrote this blog. It walks through what happens depending on who caused the accident, what your policy covers, and what to do if the insurance company tries to push back.

Florida changed the statute of limitations for negligence claims in 2023.

Attorney Jeffrey Vizcaino of Pardy & Rodriguez explains that negligence claims accruing after the law changed generally have a two-year statute of limitations instead of the previous four years.

That date matters.
An accident from before the change may fall under a different deadline than one that happened after it.

If you think you may have a negligence claim, don't assume you still have four years to take action. Contact Pardy & Rodriguez, P.A. to get your questions answered and talk about your potential claim.

What are the requirements for riding an electric scooter in Florida?

The rules depend on the type of scooter you are riding and where you're riding it.

Insurance and registration requirements can vary depending on what you're operating, but traffic laws still matter.

If an accident happens, fault and the insurance coverage available to each person can also affect who pays for the damages.

Contact Pardy & Rodriguez, P.A. to get your questions answered and talk about your potential claim.

When we negotiate for you, we do our best fighting for what's fair.

Why? Because injuries can affect more than just today. It's missing out on a lot of things you used to be able to do when you weren't injured. That's why if a fair number cannot be settled during mediation, the fight goes to court next.
